ARAGON | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO PROFESSIONAL LICENSES; AMENDING THE MINIMUM PASSING | 0012| SCORE ON EXAMINATIONS FOR PSYCHOLOGISTS AND PSYCHOLOGIST | 0013| ASSOCIATES; ALLOWING LICENSURE UNDER CERTAIN CONDITIONS. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 61-9-11 NMSA 1978 (being Laws 1963, | 0017| Chapter 92, Section 10, as amended) is amended to read: | 0018| "61-9-11. LICENSURE--EXAMINATION.-- | 0019| A. The board shall issue a license as a | 0020| psychologist to each applicant who files an application upon a | 0021| form and in such manner as the board prescribes, accompanied by | 0022| the fee required by the Professional Psychologist Act, and who | 0023| furnishes evidence satisfactory to the board that he: | 0024| (1) has reached the age of majority; | 0025| (2) is of good moral character; | 0001| (3) is not in violation of any of the | 0002| provisions of the Professional Psychologist Act and the rules | 0003| and regulations adopted pursuant to that act; | 0004| (4) holds a doctoral degree based in part on a | 0005| psychological dissertation from a school or college; | 0006| (5) has had an internship approved by the | 0007| American psychological association and one year of experience | 0008| after receiving the doctoral degree or has had, after receiving | 0009| the doctoral degree, at least two years of supervised | 0010| experience in psychological work of a type satisfactory to the | 0011| board; and | 0012| (6) demonstrates professional competence by | 0013| passing: | 0014| (a) the examination for professional | 0015| practice in psychology promulgated by the association of state | 0016| and provincial psychology boards with a minimum score | 0017| equivalent to or greater than [the statistical mean] seventy | 0018| percent as reported by the association of state and provincial | 0019| psychology boards for all doctoral-level candidates taking the | 0020| examination on that occasion; and | 0021| (b) an oral examination administered and | 0022| graded by the board, investigating the applicant's training, | 0023| experience and knowledge. The oral examination shall be | 0024| evaluated on a pass-fail basis. | 0025| B. Upon investigation of the application and other | 0001| evidence submitted, the board shall, not less than thirty days | 0002| prior to the examination, notify each applicant that the | 0003| application and evidence submitted for licensure are | 0004| satisfactory and accepted or unsatisfactory and rejected. If | 0005| rejected, the notice shall state the reasons for rejection. | 0006| C. The place of examination shall be designated in | 0007| advance by the board, and examinations shall be given at such | 0008| time and place and under such supervision as the board may | 0009| determine. | 0010| D. In the event an applicant fails to receive a | 0011| passing grade, he may apply for [re-examinations] | 0012| reexamination and shall be allowed to take a subsequent | 0013| examination upon payment of the fee required by the | 0014| Professional Psychologist Act. | 0015| E. The board shall keep a record of all | 0016| examinations, and the grade assigned to each, as part of its | 0017| records for at least two years subsequent to the date of | 0018| examination." | 0019| Section 2. Section 61-9-11.1 NMSA 1978 (being Laws 1983, | 0020| Chapter 334, Section 4, as amended) is amended to read: | 0021| "61-9-11.1. PSYCHOLOGIST ASSOCIATES--LICENSURE-- | 0022| EXAMINATION.-- | 0023| A. The board shall issue a license as a | 0024| psychologist associate to each applicant who files an | 0025| application upon a form and in such manner as the board | 0001| prescribes, accompanied by the fee required by the Professional | 0002| Psychologist Act, and who furnishes evidence satisfactory to | 0003| the board that he: | 0004| (1) has reached the age of majority, is of | 0005| good moral character and is not in violation of any of the | 0006| provisions of the Professional Psychologist Act and the rules | 0007| and regulations adopted pursuant to that act; | 0008| (2) holds a master's degree in psychology from | 0009| a department of psychology of a school or college; | 0010| (3) has had, after receiving the master's | 0011| degree, at least five years of experience, one of which shall | 0012| be supervised, in psychological work of a type satisfactory to | 0013| the board; and | 0014| (4) demonstrates professional competence by | 0015| passing: | 0016| (a) the examination for professional | 0017| practice in psychology promulgated by the association of state | 0018| and provincial psychology boards with a score equivalent to or | 0019| greater than [the statistical mean] sixty-five percent as | 0020| reported by the association of state and provincial psychology | 0021| boards for all master's-level candidates taking the examination | 0022| on that occasion; and | 0023| (b) an oral examination administered and | 0024| graded by the board, investigating the applicant's training, | 0025| experience and knowledge of his area of practice. The oral | 0001| examination shall be evaluated on a pass-fail basis. | 0002| B. The board may adopt reasonable rules and | 0022| regulations classifying areas and conditions of practice | 0023| permissible for psychologist associates." | 0024| Section 3. TEMPORARY PROVISION--LICENSURE UNDER CERTAIN | 0025| CONDITIONS.--For the purposes of licensing psychologists | 0001| pursuant to the Professional Psychologist Act, an applicant who | 0002| has a doctoral degree; has five years' post-doctoral experience | 0003| within the ten years prior to July 31, 1997; has scored at | 0004| least seventy percent on the examination for professional | 0005| practice in psychology promulgated by the association of state | 0006| and provincial psychology boards; and meets all the other | 0007| requirements set forth in the Professional Psychologist Act | 0008| shall be deemed to have met all the qualifications for | 0009| licensure. | 0010|  |
