0011| RELATING TO JUVENILE JUSTICE; PROVIDING MUNICIPAL, MAGISTRATE

0012| AND METROPOLITAN COURTS WITH EXCLUSIVE, ORIGINAL JURISDICTION

0013| OVER CERTAIN MISDEMEANOR OFFENSES; ENACTING A NEW SECTION OF
|
0014| THE DELINQUENCY ACT.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new section of the Delinquency Act is
|
0018| enacted to read:
|
0019| "[NEW MATERIAL] JURISDICTION FOR CERTAIN MISDEMEANOR
|
0020| OFFENSES.--
|
0021| A. Notwithstanding other provisions of the
|
0022| Children's Code and subject to the exception set forth in
|
0023| Subsection B of this section, the municipal, magistrate or
|
0024| metropolitan court shall have original, exclusive jurisdiction
|
0025| over the following misdemeanor offenses, when the person
|
0001| alleged to have committed the offense is a child and he has no
|
0002| more than one prior adjudication for any of the following
|
0003| misdemeanor offenses:
|
0004| (1) assault, as provided in Section 30-3-1
|
0005| NMSA 1978;
|
0006| (2) battery, as provided in Section 30-3-4
|
0007| NMSA 1978;
|
0008| (3) criminal trespass, as provided in Section
|
0009| 30-14-1 NMSA 1978;
|
0010| (4) graffiti, as provided in Subsection B of
|
0011| Section 30-15-1.1 NMSA 1978;
|
0012| (5) shoplifting, as provided in Paragraph (1)
|
0013| or (2) of Subsection B of Section 30-16-20 NMSA 1978;
|
0014| (6) possession of one ounce or less of
|
0015| marijuana, as provided in Paragraph (1) of Subsection B of
|
0016| Section 30-31-23 NMSA 1978; and
|
0017| (7) possession of alcohol by a minor, as
|
0018| provided in Section 60-7B-1 NMSA 1978.
|
0019| B. If the children's court acquires jurisdiction
|
0020| over a child pursuant to the alleged commission of a delinquent
|
0021| act not set forth in Subsection A of this section, it shall
|
0022| have jurisdiction over all offenses alleged to have been
|
0023| committed by the child arising out of the same occurrence.
|
0024| C. When the municipal, magistrate or metropolitan
|
0025| court finds that a child committed an offense set forth in
|
0001| Subsection A of this section, it shall forward a copy of the
|
0002| disposition report to the district court. The district court
|
0003| shall maintain a registry of such disposition reports received
|
0004| from a municipal, magistrate or metropolitan court."
|
0005| Section 2. EFFECTIVE DATE.--The effective date of the
|
0006| provisions of this act is July 1, 1997.

0023| 1. On page 2, between lines 18 and 19, insert the following
|
0024| new subsection:
|

|
0001| "B. A municipal, magistrate or metropolitan court shall
|
0002| not incarcerate a child who has been adjudicated for an offense
|
0003| set forth in Subsection A of this section without first securing
|
0004| the approval of the children's court.".

|
0006| 2. Reletter the succeeding subsections accordingly.
