0011|     RELATING TO PUBLIC BUILDING ENERGY EFFICIENCY; BROADENING THE
    |
0012|     GOVERNMENTAL UNIT DEFINITION IN THE PUBLIC BUILDING ENERGY
    |
0013|     EFFICIENCY ACT; PROVIDING FOR FUNDING OF ENERGY SAVINGS
    |
0014|     CONTRACTS, RELATED LEASE-PURCHASE AGREEMENTS AND INSTALLMENT
    |
0015|     PAYMENT CONTRACTS; MAKING AN APPROPRIATION;
    |

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  Section 6-23-2 NMSA 1978 (being Laws 1993,
    |
0019|     Chapter 231, Section 2) is amended to read:
    |
0020|          "6-23-2.  DEFINITIONS.--As used in the Public Building
    |
0021|     Energy Efficiency Act:
    |
0022|               A.  "energy conservation measure" means a training
    |
0023|     program or facility alteration designed to reduce energy
    |
0024|     consumption or operating costs and may include:
    |
0025|                    (1)  insulation of the building structure or
    |
0001|     systems within the building;
    |
0002|                    (2)  storm windows or doors, caulking or
    |
0003|     weatherstripping, multiglazed windows or doors, heat absorbing
    |
0004|     or heat reflective glazed and coated window or door systems,
    |
0005|     additional glazing, reductions in glass area or other window
    |
0006|     and door system modifications that reduce energy consumption;
    |
0007|                    (3)  automated or computerized energy control
    |
0008|     systems;
    |
0009|                    (4)  heating, ventilating or air conditioning
    |
0010|     system modifications or replacements;
    |
0011|                    (5)  replacement or modification of lighting
    |
0012|     fixtures to increase the energy efficiency of the lighting
    |
0013|     system without increasing the overall illumination of a
    |
0014|     facility, unless an increase in illumination is necessary to
    |
0015|     conform to the applicable state or local building code for the
    |
0016|     lighting system after the proposed modifications are made;
    |
0017|                    (6)  energy recovery systems;
    |
0018|                    (7)  solar heating and cooling systems or other
    |
0019|     renewable energy systems;
    |
0020|                    (8)  cogeneration systems that produce steam or
    |
0021|     forms of energy such as heat, as well as electricity, for use
    |
0022|     primarily within a building or complex of buildings; or
    |
0023|                    (9)  energy conservation measures that provide
    |
0024|     long-term operating cost reductions;
    |
0025|               B.  "governmental unit" means an agency, institution
    |
0001|     or instrumentality of the state; <u>a two- or four-year
</u>    |
<u></u>0002| <u>    institution of higher education</u>; a municipality; a county; or
    |
0003|     a school district;
    |
0004|               C.  "guaranteed energy savings contract" means a
    |
0005|     contract for the evaluation and recommendation of energy
    |
0006|     conservation measures and for the implementation of one or more
    |
0007|     of those measures, and which contract provides that all
    |
0008|     payments, except obligations on termination of the contract
    |
0009|     before its expiration, are to be made over time and the savings
    |
0010|     are guaranteed to the extent necessary to make the payments for
    |
0011|     the energy conservation measures; and
    |
0012|               D.  "qualified provider" means a person or business
    |
0013|     experienced in the design, implementation and installation of
    |
0014|     energy conservation measures and who meets the experience
    |
0015|     qualifications developed by the energy, minerals and natural
    |
0016|     resources department."
    |
0017|          Section 2.  Section 6-23-10 NMSA 1978 (being Laws 1993,
    |
0018|     Chapter 231, Section 10) is amended to read:
    |
0019|          "6-23-10.  STATE INSTITUTIONS AND BUILDINGS--USE OF
    |
0020|     CERTAIN REVENUES AUTHORIZED.--Income from lands granted for the
    |
0021|     use of certain institutions and public buildings and deposited
    |
0022|     in income funds for such institutions and buildings pursuant to
    |
0023|     Section 19-1-17 NMSA 1978 may be appropriated and pledged for
    |
0024|     payments pursuant to any guaranteed energy savings contract or
    |
0025|     related lease-purchase agreement or installment payment
    |
0001|     contract pursuant to the Public Building Energy Efficiency Act. 
    |
0002|     Any money so appropriated shall be deposited in a special fund
    |
0003|     or account of the institution or fund and that revenue and no
    |
0004|     other revenue shall be used to make such payments to the Public
    |
0005|     Building Energy Efficiency Act. <u>Utility and maintenance
</u>    |
<u></u>0006| <u>    appropriations to governmental units shall not be reduced over
</u>    |
<u></u>0007| <u>    the term of the guaranteed energy savings contract, the related
</u>    |
<u></u>0008| <u>    lease-purchase agreement or the installment payment contract.</u>"
