0011|     RELATING TO MUNICIPALITIES; ELIMINATING AN ALTERNATIVE

0012|     INCORPORATION PROCESS THAT ALLOWS A TERRITORY TO INCORPORATE AS

0013|     A MUNICIPALITY BASED ON CERTAIN TOURISM AND RESIDENCE CRITERIA;

0014|     AMENDING A SECTION OF THE NMSA 1978.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 3-2-2 NMSA 1978 (being Laws 1965,
    |
0018|     Chapter 300, Section 14-2-2, as amended) is amended to read:
    |
0019|          "3-2-2.  CHARACTERISTICS OF TERRITORY PROPOSED TO BE
    |
0020|     INCORPORATED AS A MUNICIPALITY. <s>[A.]</s>  Any territory proposed
    |
0021|     to be incorporated as a municipality shall:
    |
0022|               <s>[(1)]</s> <u>A.</u>  not be within the boundary of another
    |
0023|     municipality;
    |
0024|               <s>[(2)]</s> <u>B.</u>  have a population density of not less
    |
0025|     than one person per acre, except for a class B county with net
    |
0001|     taxable value of property for property tax purposes in 1990 of
    |
0002|     over ninety-five million dollars ($95,000,000) and a population
    |
0003|     of less than ten thousand according to the 1990 federal
    |
0004|     decennial census and where the population density of the
    |
0005|     territory proposed to be incorporated is not less than one
    |
0006|     person per four acres; and
    |
0007|               <s>[(3)]</s> <u>C.</u>  contain not less than one hundred
    |
0008|     fifty persons.
    |

0009|               <s>[B.  In the alternative to the requirements of

<s></s>0010| <s>    Paragraph 2 of Subsection A of this section, any territory
</s>    |
<s></s>0011| <s>    proposed to be incorporated as a municipality shall:
</s>    |
<s></s>0012| <s>                   (1)  contain within its boundaries a resort
</s>    |
<s></s>0013| <s>    area having more than fifty thousand visitors a year; and
</s>    |
<s></s>0014| <s>                   (2)  have more than one hundred fifty single-
</s>    |
<s></s>0015| <s>    family residences, as shown by the property tax rolls.]</s>"
