0011| RELATING TO EDUCATION; AMENDING A SECTION OF THE PUBLIC SCHOOL

0012| FINANCE ACT TO MANDATE PROGRAM-BASED BUDGETING.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 22-8-9 NMSA 1978 (being Laws 1967,
|
0016| Chapter 16, Section 63, as amended) is amended to read:
|
0017| "22-8-9. BUDGETS--MINIMUM REQUIREMENTS.--
|
0018| A. No budget for a school district shall be
|
0019| approved by the department that does not provide for:
|
0020| (1) a school year consisting of at least one
|
0021| hundred eighty full instructional days or the equivalent
|
0022| thereof, exclusive of any release time for in-service training;
|
0023| or
|
0024| (2) a variable school year consisting of a
|
0025| minimum number of instructional hours established by the state
|
0001| board; and
|
0002| (3) a pupil-teacher ratio or class or teaching
|
0003| load as provided in Section 22-2-8.2 NMSA 1978; and
|
0004| (4) effective July 1, 1997, a full-time,
|
0005| department-certified nurse for each fifty-five teachers
|
0006| employed by a school district or the equivalent part-time,
|
0007| department-certified nurse for less than fifty-five teachers.
|
0008| B. No budget for a school district shall be
|
0009| approved by the department that does not provide for a program-
|
0010| based budget for each school in the district and for the
|
0011| district as a whole.
|
0012| [B.] C. The state board shall, by regulation,
|
0013| establish the requirements for a teaching day, the standards
|
0014| for an instructional hour and the standards for a full-time
|
0015| certified classroom instructor and for the equivalent thereof.
|
0016| [C.] D. The local school board shall submit a
|
0017| plan for the implementation of an alternate school year to the
|
0018| state superintendent for his approval.
|
0019| [D.] E. The provisions of Subsection [C] D
|
0020| and Paragraph (2) of Subsection A of this section shall be
|
0021| construed to apply only to school districts with a MEM of one
|
0022| thousand or fewer."
|
0023| Section 2. APPLICABILITY.--The provisions of this act
|
0024| apply to budgets for fiscal year 1999 and subsequent fiscal
|
0025| years.

0003| RELATING TO EDUCATION; DEVELOPING PROGRAM-BASED BUDGETING;

0004| MAKING AN APPROPRIATION.
|

0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0007| Section 1. [NEW MATERIAL] PROGRAM-BASED BUDGETING.--
|
0008| A. The state department of public education shall
|
0009| facilitate the development of procedures for the implementation
|
0010| of program-based budgeting for each school in a school
|
0011| district.
|
0012| B. Participants in the development shall be school
|
0013| district business managers and representatives of the
|
0014| association of school business officials.
|
0015| C. An interim status report for fiscal year 1998
|
0016| shall be provided to the legislative education study committee.
|
0017| Section 2. APPROPRIATION.--Fifteen thousand dollars
|
0018| ($15,000) is appropriated from the general fund to the state
|
0019| department of public education in fiscal year 1998 for the
|
0020| purpose of paying mileage and per diem costs incurred as a
|
0021| result of the development of program-based budgeting. Any
|
0022| unexpended or unencumbered balance remaining at the end of
|
0023| fiscal year 1998 shall revert to the general fund.
