0011| RELATING TO WATER, AMENDING SECTION 73-2-66 NMSA 1978 (BEING

0012| LAWS 1993, CHAPTER 293, SECTION 2) TO EXPAND THE POWERS OF THE

0013| ACEQUIA COMMISSION; MAKING AN APPROPRIATION.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 73-2-66 NMSA 1978 (being Laws 1993,
|
0017| Chapter 293, Section 2) is amended to read:
|
0018| "73-2-66. POWERS AND DUTIES.--The acequia commission
|
0019| shall:
|
0020| A. provide advice and assist the governor,
|
0021| legislature, office of the state engineer and interstate stream
|
0022| commission and the United States army corps of engineers in
|
0023| establishing acequia and community ditch rehabilitation
|
0024| priorities and in other acequia and community ditch matters;
|
0025| B. serve as a facilitator for communication between
|
0001| acequia and community ditch associations and state and federal
|
0002| agencies; [and]
|
0003| C. review and comment on any plan or legislation
|
0004| affecting acequias or community ditches to the governor, the
|
0005| legislature, the secretary of agriculture and the interstate
|
0006| stream commission;
|
0007| D. conduct educational forums for the public on
|
0008| the history and cultural importance of New Mexico's acequias;
|
0009| and
|
0010| E. provide information to the acequia association
|
0011| on state and federal funds and programs beneficial to the
|
0012| acequias."

0013| Section 2. APPROPRIATION.--Fifty thousand dollars
|
0014| ($50,000) is appropriated from the general fund to the local
|
0015| government division of the department of finance and
|
0016| administration for expenditure in fiscal year 1998 by the
|
0017| acequia commission for the purpose of carrying out the
|
0018| commission's powers and duties. Any unexpended or unencumbered
|
0019| balance remaining at the end of fiscal year 1998 shall revert
|
0020| to the general fund.
