0011|     RELATING TO REVENUE; ESTABLISHING A FUND FOR THE RECEIPT OF

0012|     CERTAIN REVENUE RECEIVED BY THE CONSTRUCTION INDUSTRIES

0013|     DIVISION OF THE REGULATION AND LICENSING DEPARTMENT;
    |
0014|     AUTHORIZING EXPENDITURES FROM THE FUND; AMENDING AND REPEALING
    |
0015|     SECTIONS OF THE NMSA 1978; MAKING AN APPROPRIATION.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  Section 9-16-14 NMSA 1978 (being Laws 1987,
    |
0019|     Chapter 298, Section 1, as amended) is amended to read:
    |
0020|          "9-16-14.  REGULATION AND LICENSING DEPARTMENT OPERATING
    |
0021|     FUND.--
    |
0022|               A.  There is established in the state treasury the
    |
0023|     "regulation and licensing department operating fund" to be
    |
0024|     administered by the department.
    |
0025|               B.  All money received by the administrative
    |
0001|     services division, <s>[the construction industries division]</s> the
    |
0002|     financial institutions division, the securities division and
    |
0003|     the manufactured housing division, other than money earmarked
    |
0004|     for revolving funds, shall be deposited with the state
    |
0005|     treasurer and held in a separate suspense account for each
    |
0006|     division. <s>[In the seventy-sixth fiscal year, all money
</s>    |
<s></s>0007| <s>    deposited in the suspense accounts shall be transferred monthly
</s>    |
<s></s>0008| <s>    to the general fund until the sum of all money transferred to
</s>    |
<s></s>0009| <s>    the general fund equals the total amount deposited and
</s>    |
<s></s>0010| <s>    transferred to the general fund from those divisions in the
</s>    |
<s></s>0011| <s>    seventy-fourth fiscal year.  All additional money deposited in
</s>    |
<s></s>0012| <s>    the divisions' suspense accounts during the seventy-sixth
</s>    |
<s></s>0013| <s>    fiscal year shall be transferred to the regulation and
</s>    |
<s></s>0014| <s>    licensing department operating fund on June 30, 1988.]</s>
    |
0015|               C. <s>[In the seventy-seventh fiscal year and each
</s>    |
<s></s>0016| <s>    fiscal year thereafter]</s> On the last day of each month, the
    |
0017|     department shall transfer all money received during the month
    |
0018|     from the divisions' suspense accounts <u>specified in Subsection
</u>    |
<u></u>0019| <u>    B of this section</u> to the general fund."
    |
0020|          Section 2.  Section 60-13-21 NMSA 1978 (being Laws 1967,
    |
0021|     Chapter 199, Section 24, as amended) is amended to read:
    |
0022|          "60-13-21.  DIVISION--DISPOSITION OF FEES <u>FUND CREATED--
</u>    |
<u></u>0023| <u>    APPROPRIATION.--The "construction industries division operating
</u>    |
<u></u>0024| <u>    fund" is created.</u>  Fees received by the division <s>[except
</s>    |
<s></s>0025| <s>    journeymen examination fees, shall be paid to the state
</s>    |
<s></s>0001| <s>    treasurer for deposit and transfer as provided in Section 9-16-
</s>    |
<s></s>0002| <s>    14 NMSA 1978]</s> <u>shall be deposited with the state treasurer to
</u>    |
<u></u>0003| <u>    be credited to the fund.  Balances in the fund shall not
</u>    |
<u></u>0004| <u>    revert.  Money in the fund is appropriated to the division. 
</u>    |
<u></u>0005| <u>    Expenditures from the fund may be made only in accordance with
</u>    |
<u></u>0006| <u>    budgets approved by the department of finance and
</u>    |
<u></u>0007| <u>    administration and only to pay for the administration of and to
</u>    |
<u></u>0008| <u>    carry out the purposes of the Construction Industries Licensing
</u>    |
<u></u>0009| <u>    Act</u>."
    |
0010|          Section 3.  REPEAL.--Section 60-13-40.1 NMSA 1978 (being
    |
0011|     Laws 1983, Chapter 82, Section 2, as amended) is repealed.
    |
0012|          Section 4.  EFFECTIVE DATE.--The effective date of the
    |
0013|     provisions of this act is July 1, 1997.
