0011| RELATING TO EMERGENCY MANAGEMENT; CHANGING THE DEFINITION OF
|
0012| ORPHAN HAZARDOUS MATERIALS TO INCLUDE SUBSTANCES USED IN THE
|
0013| MANUFACTURE OF ILLEGAL CONTROLLED SUBSTANCES.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 74-4B-3 NMSA 1978 (being Laws 1983,
|
0017| Chapter 80, Section 3, as amended) is amended to read:
|
0018| "74-4B-3. DEFINITIONS.--As used in the Emergency
|
0019| Management Act:
|
0020| A. "accident" means an event involving hazardous
|
0021| materials that may cause injury to persons or damage to
|
0022| property or release hazardous materials to the environment;
|
0023| B. "administrator" means the hazardous materials
|
0024| emergency response administrator;
|
0025| C. "board" means the hazardous materials safety
|
0001| board;
|
0002| D. "chief" means the chief of the New Mexico state
|
0003| police;
|
0004| E. "commission" means the state emergency response
|
0005| commission;
|
0006| F. "department" means the department of public
|
0007| safety;
|
0008| G. "emergency management" means the ability to
|
0009| prepare for, respond to, mitigate, recover and restore the
|
0010| scene of an institutional, industrial, transportation or other
|
0011| accident;
|
0012| H. "first responder" means the first law
|
0013| enforcement officer or other public service provider with a
|
0014| radio-equipped vehicle to arrive at the scene of an accident;
|
0015| I. "hazardous materials" means hazardous
|
0016| substances, radioactive materials or a combination of hazardous
|
0017| substances and radioactive materials;
|
0018| J. "hazardous substances" means flammable solids,
|
0019| semisolids, liquids or gases; poisons; corrosives; explosives;
|
0020| compressed gases; reactive or toxic chemicals; irritants; or
|
0021| biological agents, but does not include radioactive materials;
|
0022| K. "orphan hazardous materials" means hazardous
|
0023| substances, radioactive materials, [or] a combination of
|
0024| hazardous substances and radioactive materials or substances
|
0025| used in the manufacture of controlled substances in violation
|
0001| of the Controlled Substances Act where an owner of the
|
0002| substances or materials cannot be identified;
|
0003| L. "plan" means the statewide hazardous materials
|
0004| emergency response plan;
|
0005| M. "radioactive materials" means any material or
|
0006| combination of materials that spontaneously emits ionizing
|
0007| radiation. Materials in which the estimated specific activity
|
0008| is not greater than 0.002 microcuries per gram of material are
|
0009| not considered to be radioactive materials unless determined to
|
0010| be so by the hazardous and radioactive materials bureau of the
|
0011| water and waste management division of the department of
|
0012| environment for purposes of emergency response pursuant to the
|
0013| Emergency Management Act;
|
0014| N. "responsible state agency" means an agency
|
0015| designated in Subsection D of Section 74-4B-5 NMSA 1978 with
|
0016| responsibility for managing a certain type of accident or
|
0017| performing certain functions at the scene of such accident;
|
0018| O. "secretary" means the secretary of public
|
0019| safety; and
|
0020| P. "task force" means the emergency management task
|
0021| force."
|
0022| Section 2. EFFECTIVE DATE.--The effective date of the
|
0023| provisions of this act is July 1, 1997.
