0011| CREATING A JOINT INTERIM LEGISLATIVE ECONOMIC DEVELOPMENT
|
0012| COMMITTEE; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. ECONOMIC DEVELOPMENT COMMITTEE CREATED--
|
0016| TERMINATION.--There is created a joint interim legislative
|
0017| committee which shall be known as the "economic development
|
0018| committee". The committee shall function from the date of its
|
0019| appointment until the first day of December prior to the first
|
0020| session of the forty-fourth legislature.
|
0021| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0022| A. The economic development committee shall be
|
0023| composed of twelve members. The New Mexico legislative council
|
0024| shall appoint six members from the house of representatives and
|
0025| six members from the senate. At the time of making the
|
0001| appointment, the legislative council shall designate the
|
0002| chairman and vice chairman of the committee.
|
0003| B. Members shall be appointed from each house so as
|
0004| to give the two major political parties in each house the same
|
0005| proportionate representation on the committee as prevails in
|
0006| each house; however, in no event shall either party have less
|
0007| than one member from each house on the committee. At the
|
0008| request of the committee chairman, members may be removed from
|
0009| the committee by the New Mexico legislative council for
|
0010| nonattendance according to council policy. Vacancies on the
|
0011| committee, however caused, may be filled by the legislative
|
0012| council, or the council may reduce the size of the committee by
|
0013| not making replacement appointments and in such case need not
|
0014| readjust party representation.
|
0015| C. No action shall be taken by the committee if a
|
0016| majority of the total membership from either house on the
|
0017| committee rejects such action.
|
0018| Section 3. DUTIES.--After its appointment, the economic
|
0019| development committee shall hold one organizational meeting to
|
0020| develop a work plan and budget for the ensuing interim. The
|
0021| work plan and budget shall be submitted to the New Mexico
|
0022| legislative council for approval. Upon approval of the work
|
0023| plan and budget by the legislative council, the committee shall
|
0024| examine the statutes, constitutional provisions, regulations
|
0025| and court decisions governing economic development in New
|
0001| Mexico and recommend legislation or changes if any are found to
|
0002| be necessary to the first session of the forty-fourth
|
0003| legislature.
|
0004| Section 4. SUBCOMMITTEES.--Subcommittees shall be created
|
0005| only by majority vote of all members appointed to the economic
|
0006| development committee and with the prior approval of the New
|
0007| Mexico legislative council. A subcommittee shall be composed
|
0008| of at least one member from the senate and one member from the
|
0009| house of representatives, and at least one member of the
|
0010| minority party shall be a member of the subcommittee. All
|
0011| meetings and expenditures of a subcommittee shall be approved
|
0012| by the full committee in advance of such meeting or
|
0013| expenditure, and the approval shall be shown in the minutes of
|
0014| the committee.
|
0015| Section 5. REPORT.--The economic development committee
|
0016| shall make a report of its findings and recommendations for the
|
0017| consideration of the first session of the forty-fourth
|
0018| legislature. The report and suggested legislation shall be
|
0019| made available to the New Mexico legislative council on or
|
0020| before December 15 preceding that session.
|
0021| Section 6. STAFF.--The staff for the economic development
|
0022| committee shall be provided by the legislative council service.
|
0023| Section 7. APPROPRIATION.--Thirty-five thousand dollars
|
0024| ($35,000) is appropriated from the general fund to the
|
0025| legislative council service for expenditure in fiscal years
|
0001| 1997, 1998 and 1999 for the purpose of paying the salaries and
|
0002| expenses of the technical, legal, clerical and stenographic
|
0003| assistants, for necessary equipment and supplies used in
|
0004| carrying out the provisions of this act and for reimbursing the
|
0005| per diem and mileage expenses of the economic development
|
0006| committee. Any unexpended or unencumbered balance remaining at
|
0007| the end of fiscal year 1999 shall revert to the general fund.
|
0008| Payments from the appropriation shall be made upon vouchers
|
0009| signed by the director of the legislative council service or
|
0010| his authorized representative.
|
0011| Section 8. EMERGENCY.--It is necessary for the public
|
0012| peace, health and safety that this act take effect immediately.
|
