0011| RELATING TO MEDICAID; AMENDING SECTION 27-2A-3 NMSA 1978 (BEING

0012| LAWS 1994, CHAPTER 87, SECTION 3); REPEALING THE MEDICAID

0013| ESTATE RECOVERY ACT UPON ENACTMENT OF FEDERAL MEDICAID BLOCK

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 27-2A-3 NMSA 1978 (being Laws 1994,
|
0018| Chapter 87, Section 3) is amended to read:
|
0019| "27-2A-3. DEFINITIONS.--As used in the Medicaid Estate
|
0020| Recovery Act:
|
0021| A. "department" means the human services
|
0022| department;
|
0023| B. "estate" means real and personal property and
|
0024| other assets of the individual subject to probate or
|
0025| administration pursuant to the provisions of the Uniform
|
0001| Probate Code; [and]
|
0002| C. "homestead of modest value" means a property
|
0003| that does not exceed one hundred thousand dollars ($100,000) in
|
0004| value for property tax purposes; and
|
0005| [C.] D. "medical assistance" means amounts paid
|
0006| by the department as medical assistance pursuant to Title
|
0007| [XIX] 19 of the Social Security Act."
|
0008| Section 2. REPEAL.--Upon the effective date of any
|
0009| federal statute eliminating medicaid entitlement in favor of
|
0010| medicaid block grants to the states, Sections 27-2A-1 through
|
0011| 27-2A-9
|
0012| NMSA 1978 (being Laws 1994, Chapter 87, Sections 1 through 9)
|
0013| are repealed.
