0011|     RELATING TO DISTRICT ATTORNEYS; PROVIDING SALARY INCREASES FOR

0012|     DISTRICT ATTORNEYS; AMENDING A SECTION OF THE NMSA 1978; MAKING

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 36-1-6 NMSA 1978 (being Laws
    |
0017|     1976(S.S), Chapter 18, Section 1, as amended) is amended to
    |
0018|     read:
    |
0019|          "36-1-6.  DISTRICT ATTORNEYS--SALARIES.--
    |
0020|               A.  Except as provided in Subsection B of this
    |
0021|     section, district attorneys shall receive an annual salary of
    |
0022|     <s>[seventy thousand two hundred sixty-five dollars ($70,265)]</s>
    |
0023|     <u>seventy-seven thousand two hundred ninety-two dollars
</u>    |
<u></u>0024| <u>    ($77,292)</u>.
    |
0025|               B.  District attorneys who serve in a district
    |
0001|     <s>[that includes a class A county within the district]</s> <u>where
</u>    |
<u></u>0002| <u>    the current population exceeds one hundred thousand people</u>
    |
0003|     shall receive an annual salary of <s>[seventy-three thousand nine
</s>    |
<s></s>0004| <s>    hundred sixty-three dollars ($73,963)]</s> <u>eighty-one thousand
</u>    |
<u></u>0005| <u>    three hundred sixty dollars ($81,360).</u>
    |
0006|               <u>C.  For fiscal year 1999 and all subsequent fiscal
</u>    |
<u></u>0007| <u>    years, the annual salary for district attorneys shall be
</u>    |
<u></u>0008| <u>    established by the legislature in an appropriations act.</u>"
    |
0009|          Section 2.  APPROPRIATION.--One hundred forty-five
    |
0010|     thousand four hundred dollars ($145,400) is appropriated from
    |
0011|     the general fund to the administrative office of the district
    |
0012|     attorneys for expenditure in fiscal year 1998 for the purpose
    |
0013|     of paying salaries and benefits for district attorneys.  Any
    |
0014|     unexpended or unencumbered balance remaining at the end of
    |
0015|     fiscal year 1998 shall revert to the general fund.
    |
0016|          Section 3.  EFFECTIVE DATE.--The effective date of the
    |
0017|     provisions of this act is July 1, 1997.
