0012| RELATING TO HEALTH; PERMITTING LIMITED LOCAL REGULATION OF

0013| PESTICIDES.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 76-4-9.1 NMSA 1978 (being Laws 1992,
|
0017| Chapter 25, Section 1) is amended to read:
|
0018| "76-4-9.1. STATE PREEMPTION EXCEPTION.--
|
0019| A. Except as otherwise authorized in the
|
0020| Pesticide Control Act, no city, county or other political
|
0021| subdivision of the state and no home rule municipality shall
|
0022| adopt or continue in effect any ordinance, rule, regulation or
|
0023| statute regarding the registration, labeling, distribution,
|
0024| sale, handling, use, application, transportation or disposal of
|
0025| pesticides unless that ordinance, rule or regulation is more
|
0001| restrictive than state law or regulation and pertains only to
|
0002| the distribution, sale, handling, use, application,
|
0003| transportation or disposal of pesticides. Such ordinance, rule
|
0004| or regulation may include requirements for public notice of use
|
0005| or application of pesticides. The state shall retain sole
|
0006| authority regarding registration and labeling of pesticides and
|
0007| over licensing of commercial, public and private pesticide
|
0008| applicators.

0009| B. Any political subdivision or local government
|
0010| entity contemplating regulating pesticides, as permitted in
|
0011| Subsection A of this section, shall notify the director of the
|
0012| department prior to public notice of the proposed action in
|
0013| order to ensure that no provision of the proposed ordinance,
|
0014| rule or regulation conflicts with state or federal pesticide
|
0015| statutes or regulations."
