0011| RELATING TO ELECTIONS; AMENDING THE ELECTION CODE TO PROVIDE
|
0012| FOR STUDENT MEMBERS ON A PRECINCT BOARD.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 1-2-7 NMSA 1978 (being Laws 1969,
|
0016| Chapter 240, Section 29, as amended) is amended to read:
|
0017| "1-2-7. PRECINCT BOARD--QUALIFICATION OF MEMBERS.--
|
0018| A. In order to qualify as a member of the precinct
|
0019| board, a person shall:
|
0020| (1) be a resident of the representative
|
0021| district and county in which the precinct where he is a voter
|
0022| is located;
|
0023| (2) be able to read and write;
|
0024| (3) have the necessary capacity to carry out
|
0025| his functions with acceptable skill and dispatch; and
|
0001| (4) execute the precinct board member's oath
|
0002| of office.
|
0003| B. No person shall be qualified for appointment or
|
0004| service on a precinct board:
|
0005| (1) who is a candidate for any federal, state,
|
0006| district or county office;
|
0007| (2) who is a spouse, parent, child, brother or
|
0008| sister of any candidate to be voted for at the election; or
|
0009| (3) who is a sheriff, deputy sheriff, marshal,
|
0010| deputy marshal, state or municipal policeman.
|
0011| C. For the purpose of increasing awareness of the
|
0012| election process in the youth of our state, of the importance
|
0013| of participating in that process and of the responsibilities of
|
0014| a voter, a county clerk may appoint not more than two students
|
0015| to serve under the direct supervision of the presiding judge of
|
0016| a precinct designated by the county clerk. A student appointed
|
0017| by the county clerk shall:
|
0018| (1) meet the qualifications set forth in
|
0019| Subsection A of this section except the student need not be
|
0020| eligible to vote;
|
0021| (2) have the approval of the educational
|
0022| institution in which the student is enrolled;
|
0023| (3) be at least sixteen years of age at the
|
0024| time of the election in which the student is serving as a
|
0025| member of a precinct board;
|
0001| (4) be or will be a United States citizen at
|
0002| the time of the election to which the student will be serving
|
0003| as a member of a precinct board; and
|
0004| (5) be a student in good standing attending a
|
0005| public or private secondary educational institution.
|
0006| D. No student appointed pursuant to the provisions
|
0007| of Subsection C of this section shall serve as a presiding
|
0008| judge."
|
0009| Section 2. Section 1-2-10 NMSA 1978 (being Laws 1975,
|
0010| Chapter 255, Section 16) is amended to read:
|
0011| "1-2-10. PRECINCT BOARD--APPOINTMENT BY COUNTY CLERK.--
|
0012| The county clerk shall appoint the precinct board for each
|
0013| precinct in the following order:
|
0014| A. from the list submitted by the major party
|
0015| county chairmen in the order stated thereon;
|
0016| B. from the standby list; and
|
0017| C. from any other list of voters who have the same
|
0018| qualifications and comply with the same requirements as
|
0019| provided for precinct board members except as provided in
|
0020| Subsection C of Section 1-2-7 NMSA 1978."
