0011| RELATING TO MEDICAID; ESTABLISHING THE MEDICAID REIMBURSEMENT

0012| RATE AT NOT LESS THAN THE MEDICARE RATE FOR THE SAME SERVICE.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 27-2-12.3 NMSA 1978 (being Laws 1987,
|
0016| Chapter 269, Section 1, as amended) is amended to read:
|
0017| "27-2-12.3. MEDICAID REIMBURSEMENT--EQUAL PAY FOR EQUAL
|
0018| PHYSICIANS', DENTISTS', OPTOMETRISTS', PODIATRISTS' AND
|
0019| PSYCHOLOGISTS' SERVICES.--The human services department shall
|
0020| establish a rate for the reimbursement of physicians, dentists,
|
0021| optometrists, podiatrists and psychologists for services
|
0022| rendered to medicaid patients that provides equal reimbursement
|
0023| for the same or similar services rendered without respect to
|
0024| the date on which [such] the physician, dentist,
|
0025| optometrist, podiatrist or psychologist entered into practice
|
0001| in New Mexico, the date on which the physician, dentist,
|
0002| optometrist,
|
0003| podiatrist or psychologist entered into an agreement or
|
0004| contract to provide such services or the location in which
|
0005| [such] the services are to be provided in the state;
|
0006| provided, however, that the requirements of this section shall
|
0007| not apply when the human services department contracts with
|
0008| entities pursuant to Section 27-2-12.6 NMSA 1978 to negotiate a
|
0009| rate for the reimbursement for services rendered to medicaid
|
0010| patients in the medicaid managed care system; and provided
|
0011| further that any medicaid reimbursement rate established by the
|
0012| department shall not be less than the rate paid by medicare for
|
0013| the same service."
