0011| RELATING TO INSURANCE; INCREASING THE EXPENSE LIMIT FROM THE

0012| PATIENT'S COMPENSATION FUND FOR THE MEDICAL REVIEW COMMISSION.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 41-5-28 NMSA 1978 (being Laws 1976,
|
0016| Chapter 2, Section 29, as amended) is amended to read:
|
0017| "41-5-28. PAYMENT OF MEDICAL REVIEW COMMISSION EXPENSES.-
|
0018| -Unless otherwise provided by law, expenses incurred in
|
0019| carrying out the powers, duties and functions of the New Mexico
|
0020| medical review commission, including the salary of the
|
0021| director, shall be paid by the patient's compensation fund.
|
0022| The superintendent, in his capacity as custodian of the fund,
|
0023| shall disburse fund money to the director upon receipt of
|
0024| vouchers itemizing expenses incurred by the New Mexico medical
|
0025| review commission. The director shall supply the chief justice
|
0001| of the New Mexico supreme court with duplicates of all vouchers
|
0002| submitted to the superintendent. Expenses paid by the fund
|
0003| shall not exceed [two hundred fifty thousand dollars
|
0004| ($250,000)] three hundred fifty thousand dollars ($350,000)
|
0005| in any single calendar year; provided, however, that expenses
|
0006| incurred in defending the commission shall not be subject to
|
0007| that maximum amount."
