0013| ASSESSING A FEE; CREATING A FUND; PROVIDING A PENALTY; MAKING

0014| AN APPROPRIATION.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. SHORT TITLE.--This act may be cited as the
|
0018| "DNA Identification Act".
|
0019| Section 2. PURPOSE OF ACT.--The purpose of the DNA
|
0020| Identification Act is to:
|
0021| A. establish a DNA identification system for
|
0022| covered offenders;
|
0023| B. facilitate the use of DNA records by law
|
0024| enforcement agencies in the identification, detection or
|
0025| exclusion of persons in connection with criminal
|
0001| investigations, prosecutions and other purposes; and
|
0002| C. assist in humanitarian endeavors, including
|
0003| identification of deceased persons, missing persons, close
|
0004| biological relatives of missing persons and disaster victims.
|
0005| Section 3. DEFINITIONS.--As used in the DNA
|
0006| Identification Act:
|
0007| A. "administrative center" means the law
|
0008| enforcement agency or unit that administers and operates the
|
0009| DNA identification system;
|
0010| B. "advisory committee" means the DNA
|
0011| identification system advisory committee;
|
0012| C. "CODIS" means the federal bureau of
|
0013| investigation's national DNA index system for storage and
|
0014| exchange of DNA records submitted by forensic DNA laboratories;
|
0015| D. "covered offender" means any person convicted of
|
0016| a felony offense under the Criminal Code or adjudicated
|
0017| pursuant to youthful offender or serious youthful offender
|
0018| proceedings under the Children's Code;
|
0019| E. "department" means the department of public
|
0020| safety;
|
0021| F. "DNA" means deoxyribonucleic acid as the basis
|
0022| of human heredity;
|
0023| G. "DNA identification system" means the DNA
|
0024| identification system established pursuant to the DNA
|
0025| Identification Act;
|
0001| H. "DNA records" means the results of DNA testing
|
0002| and related information;
|
0003| I. "DNA testing" means a forensic DNA analysis that
|
0004| includes restriction fragment length polymorphism, polymerase
|
0005| chain reaction or other valid methods of DNA typing performed
|
0006| to obtain identification characteristics of samples;
|
0007| J. "fund" means the DNA identification system fund;
|
0008| and
|
0009| K. "sample" means a sample of biological material
|
0010| sufficient for DNA testing.
|
0011| Section 4. ADMINISTRATIVE CENTER--POWERS AND DUTIES--
|
0012| TRANSFER TO OTHER LAW ENFORCEMENT AGENCY.--
|
0013| A. The administrative center shall be an
|
0014| appropriate unit of the department or such other qualified New
|
0015| Mexico law enforcement agency as the secretary of public safety
|
0016| may designate in accordance with this section.
|
0017| B. The administrative center shall:
|
0018| (1) establish and administer the DNA
|
0019| identification system. The DNA identification system shall
|
0020| provide for collection, storage, DNA testing, maintenance and
|
0021| comparison of samples and DNA records for forensic purposes.
|
0022| Such purposes shall include generation of investigative leads
|
0023| and statistical analysis of DNA profiles, as well as
|
0024| humanitarian purposes. Procedures used for DNA testing shall
|
0025| be compatible with the procedures the federal bureau of
|
0001| investigation has specified, including comparable test
|
0002| procedures, laboratory equipment, supplies and computer
|
0003| software. Procedures used shall meet or exceed CODIS' minimum
|
0004| standards for acceptance of DNA records;
|
0005| (2) coordinate sample collection activities;
|
0006| (3) perform or contract for DNA testing;
|
0007| (4) serve as a repository for samples and DNA
|
0008| records;
|
0009| (5) act as liaison with the federal bureau of
|
0010| investigation for purposes of CODIS; and
|
0011| (6) adopt regulations and procedures
|
0012| governing:
|
0013| (a) sample collection;
|
0014| (b) DNA testing; and
|
0015| (c) the DNA identification system and
|
0016| DNA records.
|
0017| C. The secretary of public safety may designate,
|
0018| pursuant to a joint powers agreement, the crime laboratory of
|
0019| the police department for the largest municipality in a class A
|
0020| county having a population of more than two hundred fifty
|
0021| thousand at the most recent federal decennial census to act as
|
0022| the administrative center.
|
0023| D. The secretary of public safety may designate,
|
0024| pursuant to a joint powers agreement, any other law enforcement
|
0025| agency to act as administrative center upon recommendation of
|
0001| four voting members of the advisory committee.
|
0002| Section 5. ADVISORY COMMITTEE--CREATED--POWERS AND
|
0003| DUTIES.--
|
0004| A. The "DNA identification system advisory
|
0005| committee" is created. The advisory committee shall be
|
0006| composed of five voting members and one nonvoting member as
|
0007| follows:
|
0008| (1) a scientific representative from the
|
0009| department crime laboratory appointed by the secretary of
|
0010| public safety;
|
0011| (2) a scientific representative from the crime
|
0012| laboratory of the police department for the largest
|
0013| municipality in a class A county having a population of more
|
0014| than two hundred fifty thousand at the most recent federal
|
0015| decennial census;
|
0016| (3) the secretary of corrections or his
|
0017| designated representative;
|
0018| (4) the state medical investigator or his
|
0019| designated representative;
|
0020| (5) the attorney general or his designated
|
0021| representative; and
|
0022| (6) the head of the administrative center or
|
0023| his designated representative, who is the nonvoting member.
|
0024| B. The advisory committee shall review and advise
|
0025| the administrative center on rules, regulations, procedures and
|
0001| policies to be adopted and sample collection and testing
|
0002| procedures.
|
0003| C. The advisory committee may advise the
|
0004| administrative center on how to best prioritize analysis of
|
0005| samples.
|
0006| Section 6. COVERED OFFENDERS SUBJECT TO COLLECTION OF
|
0007| SAMPLES.--Each covered offender shall provide one or more
|
0008| samples to the administrative center, as follows:
|
0009| A. covered offenders convicted on or after the
|
0010| effective date of the DNA Identification Act shall provide a
|
0011| sample at any time before release from any correctional
|
0012| facility or, if the covered offender is not sentenced to
|
0013| incarceration, before the end of any period of probation or
|
0014| other supervised release;
|
0015| B. covered offenders incarcerated on the effective
|
0016| date of the DNA Identification Act shall provide a sample at
|
0017| any time before release from any correctional facility; and
|
0018| C. covered offenders on probation or other
|
0019| supervised release on the effective date of the DNA
|
0020| Identification Act shall provide a sample before the end of any
|
0021| period of probation or other supervised release.
|
0022| Section 7. PROCEDURES FOR COLLECTION OF SAMPLES.--
|
0023| A. The collection of samples pursuant to the
|
0024| provisions of Section 6 of the DNA Identification Act shall be
|
0025| conducted in a medically approved manner in accordance with
|
0001| rules, regulations and procedures adopted by the administrative
|
0002| center.
|
0003| B. All persons who collect samples shall be trained
|
0004| in procedures that meet the requirements and standards
|
0005| specified in Subsection A of this section.
|
0006| C. All persons authorized to collect samples and
|
0007| their employers shall be immune from liability in any civil or
|
0008| criminal action if the collection is performed without
|
0009| negligence. This subsection shall not be deemed to create any
|
0010| additional liability or waive any immunity of public employees
|
0011| under the Tort Claims Act.
|
0012| D. Samples shall be stored in accordance with
|
0013| rules, regulations and procedures adopted by the administrative
|
0014| center.
|
0015| E. DNA testing shall be performed by the
|
0016| administrative center or a contract facility it may designate.
|
0017| F. DNA records and samples shall be securely
|
0018| classified and stored at the administrative center.
|
0019| Section 8. CONFIDENTIALITY--DISCLOSURE AND DISSEMINATION
|
0020| OF DNA RECORDS.--
|
0021| A. DNA records and samples are confidential and
|
0022| shall not be disclosed except as authorized in the DNA
|
0023| Identification Act.
|
0024| B. The administrative center shall make DNA records
|
0025| available for identification, comparison and investigative
|
0001| purposes to local, state and federal law enforcement agencies.
|
0002| The administrative center may disseminate statistical or
|
0003| research information derived from samples and DNA testing if
|
0004| all personal identification is removed.
|
0005| Section 9. ENFORCEMENT.--The attorney general or a
|
0006| district attorney may petition a district court for an order
|
0007| requiring a covered offender to:
|
0008| A. provide a sample; or
|
0009| B. provide a sample by alternative means if the
|
0010| covered offender will not cooperate.
|
0011| Section 10. ASSESSMENT OF FEE.--On and after the
|
0012| effective date of the DNA Identification Act, when a covered
|
0013| offender is convicted, the court shall assess a fee of one
|
0014| hundred dollars ($100) in addition to any other fee,
|
0015| restitution or fine. The fee shall be deposited in the fund.
|
0016|
|
0017| Section 11. PENALTY.--Any person who by virtue of his
|
0018| employment or official position possesses or has access to
|
0019| samples or DNA records and who willfully discloses any of them
|
0020| to any person or in any manner not authorized by the DNA
|
0021| Identification Act is guilty of a misdemeanor and shall be
|
0022| sentenced pursuant to the provisions of Subsection A of Section
|
0023| 31-19-1 NMSA 1978.
|
0024| Section 12. DNA FUND CREATED--PURPOSES.--
|
0025| A. The "DNA identification system fund" is created
|
0001| in the state treasury.
|
0002| B. The fund shall consist of all money received by
|
0003| appropriation, gift or grant, all money collected pursuant to
|
0004| Section 10 of the DNA Identification Act and all investment
|
0005| income from the fund.
|
0006| C. Money and investment income in the fund at the
|
0007| end of any fiscal year shall not revert to the general fund but
|
0008| shall remain in the fund.
|
0009| D. Money and investment income in the fund is
|
0010| appropriated to the administrative center for expenditure in
|
0011| fiscal year 1998 and subsequent fiscal years for the purposes
|
0012| of the fund.
|
0013| E. The fund shall be used for the purposes of the
|
0014| DNA Identification Act, including paying the expenses incurred
|
0015| by the administrative center and all other reasonable expenses.
|
0016| The administrative center may use money in the fund for loans
|
0017| or grants of money, equipment or personnel to any law
|
0018| enforcement agency, correctional facility or judicial agency
|
0019| upon recommendation of the advisory committee.
|
0020| Section 13. EFFECTIVE DATE.--The effective date of the
|
0021| provisions of this act is July 1, 1997.

0002| felony offense as an adult under the Criminal Code, the Motor
|
0003| Vehicle Code or the constitution of New Mexico or convicted as
|
0004| an adult pursuant to youthful offender or serious youthful
|
0005| offender proceedings under the Children's Code;
|
0006| E. "department" means the department of public
|
0007| safety;
|
0008| F. "DNA" means deoxyribonucleic acid as the basis of
|
0009| human heredity;
|
0010| G. "DNA identification system" means the DNA
|
0011| identification system established pursuant to the DNA
|
0012| Identification Act;
|
0013| H. "DNA records" means the results of DNA testing and
|
0014| related information;
|
0015| I. "DNA testing" means a forensic DNA analysis that
|
0016| includes restriction fragment length polymorphism, polymerase
|
0017| chain reaction or other valid methods of DNA typing performed
|
0018| to obtain identification characteristics of samples;
|
0019| J. "fund" means the DNA identification system fund; and
|
0020| K. "sample" means a sample of biological material

|
0014| Identification Act of 1994 regarding minimum standards for state
|
0015| participation in CODIS, including minimum standards for the
|
0016| acceptance, security and dissemination of DNA records;
|
0017| (2) coordinate sample collection activities;
|
0018| (3) perform or contract for DNA testing;
|
0019| (4) serve as a repository for samples and DNA
|
0020| records;
|
0021| (5) act as liaison with the federal bureau of
|
0022| investigation for purposes of CODIS; and
|
0023| (6) adopt regulations and procedures governing:
|
0024| (a) sample collection;
|
0025| (b) DNA testing;
|
0001| (c) the DNA identification system and DNA
|
0002| records; and
|
0003| (d) the acceptance, security and dissemination
|
0004| of DNA records.
|
0005| C. The secretary of public safety may designate,
|
0006| pursuant to a joint powers agreement, the crime laboratory of the
|
0007| police department for the largest municipality in a class A county
|
0008| having a population of more than two hundred fifty thousand at the
|
0009| most recent federal decennial census to act as the administrative
|
0010| center.
|
0011| D. The secretary of public safety may designate,
|
0012| pursuant to a joint powers agreement, any other law enforcement
|
0013| agency to act as administrative center upon recommendation of five
|
0014| voting members of the advisory committee.
|
0015| Section 5. DNA OVERSIGHT COMMITTEE--CREATED--POWERS AND
|
0016| DUTIES.--
|
0017| A. The "DNA identification system oversight committee"
|
0018| is created. The DNA oversight committee shall be composed of nine
|
0019| voting members as follows:
|
0020| (1) a scientific representative from the department
|
0021| crime laboratory appointed by the secretary of public safety;
|
0022| (2) a scientific representative from the crime
|
0023| laboratory of the police department for the largest municipality
|
0024| in a class A county having a population of more than two hundred
|
0025| fifty thousand at the most recent federal decennial census;
|
0001| (3) the secretary of corrections or his designated
|
0002| representative;
|
0003| (4) the state medical investigator or his
|
0004| designated representative;
|
0005| (5) the attorney general or his designated
|
0006| representative;
|
0007| (6) the president of the district attorney's
|
0008| association or his designated representative;
|
0009| (7) the chief public defender or his designated
|
0010| representative; and
|
0011| (8) the president of the New Mexico criminal
|
0012| defense lawyers association or his designated representative; and
|
0013| (9) the head of the administrative center or his
|
0014| designated representative.
|
0015| B. The DNA oversight committee shall adopt rules,
|
0016| regulations and procedures regarding the administration and
|
0017| operation of the DNA identification system.
|
0018| C. The administrative center shall review and make
|
0019| recommendations to the DNA oversight committee regarding rules,
|
0020| regulations and procedures for the administration and operation of
|
0021| the DNA identification system.
|
0022| Section 6. COVERED OFFENDERS SUBJECT TO COLLECTION OF
|
0023| SAMPLES.--Each covered offender shall provide one or more samples
|
0024| to the administrative center, as follows:
|
0025| A. covered offenders convicted on or after the effective
|
0001| date of the DNA Identification Act shall provide a sample at any
|
0002| time before release from any correctional facility or, if the
|
0003| covered offender is not sentenced to incarceration, before the end
|
0004| of any period of probation or other supervised release;
|
0005| B. covered offenders incarcerated on the effective date
|
0006| of the DNA Identification Act shall provide a sample at any time
|
0007| before release from any correctional facility; and
|
0008| C. covered offenders on probation or other supervised
|
0009| release on the effective date of the DNA Identification Act shall
|
0010| provide a sample before the end of any period of probation or
|
0011| other supervised release.
|
0012| Section 7. PROCEDURES FOR COLLECTION OF SAMPLES.--
|
0013| A. The collection of samples pursuant to the provisions
|
0014| of Section 6 of the DNA Identification Act shall be conducted in a
|
0015| medically approved manner in accordance with rules, regulations
|
0016| and procedures adopted by the DNA oversight committee.
|
0017| B. All persons who collect samples shall be trained in
|
0018| procedures that meet the requirements and standards specified in
|
0019| Subsection A of this section.
|
0020| C. All persons authorized to collect samples and their
|
0021| employers shall be immune from liability in any civil or criminal
|
0022| action with regard to the collection of samples, if the collection
|
0023| is performed without negligence. This subsection shall not be
|
0024| deemed to create any additional liability or waive any immunity of
|
0025| public employees under the Tort Claims Act.
|
0001| D. Samples shall be stored in accordance with rules,
|
0002| regulations and procedures adopted by the administrative center.
|
0003| E. DNA testing shall be performed by the administrative
|
0004| center or a contract facility it may designate.
|
0005| F. DNA records and samples shall be securely classified
|
0006| and stored at the administrative center.
|
0007| Section 8. CONFIDENTIALITY--DISCLOSURE AND DISSEMINATION OF
|
0008| DNA RECORDS.--
|
0009| A. DNA records and samples are confidential and shall
|
0010| not be disclosed except as authorized in the DNA Identification
|
0011| Act.
|
0012| B. The administrative center shall make DNA records
|
0013| available for identification, comparison and investigative
|
0014| purposes to local, state and federal law enforcement agencies.
|
0015| The administrative center may disseminate statistical or research
|
0016| information derived from samples and DNA testing if all personal
|
0017| identification is removed.
|
0018| Section 9. ENFORCEMENT.--The attorney general or a district
|
0019| attorney may petition a district court for an order requiring a
|
0020| covered offender to:
|
0021| A. provide a sample; or
|
0022| B. provide a sample by alternative means if the covered
|
0023| offender will not cooperate.
|
0024| Section 10. EXPUNGEMENT OF SAMPLES AND DNA RECORDS FROM THE
|
0025| DNA IDENTIFICATION SYSTEM AND CODIS.--
|
0001| A. A person may request expungement of his sample and
|
0002| DNA records from the DNA identification system on the grounds that
|
0003| the conviction that led to the inclusion of his sample and DNA
|
0004| records in the DNA identification system has been reversed.
|
0005| B. The administrative center shall expunge a person's
|
0006| sample and DNA records from the DNA identification system when the
|
0007| person provides the administrative center with the following
|
0008| materials:
|
0009| (1) a written request for expungement of his sample
|
0010| and DNA records; and
|
0011| (2) a certified copy of a court order that reverses
|
0012| the conviction that led to the inclusion of his sample and DNA
|
0013| records in the DNA identification system.
|
0014| C. When a person's sample and DNA records are expunged
|
0015| from the DNA identification system, the head of the administrative
|
0016| center shall ensure that the person's sample and DNA records are
|
0017| expunged from CODIS.
|
0018| Section 11. ASSESSMENT OF FEE.--On and after the effective
|
0019| date of the DNA Identification Act, when a covered offender is
|
0020| convicted, the court shall assess a fee of one hundred dollars
|
0021| ($100) in addition to any other fee, restitution or fine. The fee
|
0022| shall be deposited in the fund.
|
0023| Section 12. PENALTY.--
|
0024| A. Any person who by virtue of his employment or
|

0001| records and who willfully discloses any of them to any person or
|
0002| in any manner not authorized by the DNA Identification Act is
|
0003| guilty of a fourth degree felony and shall be sentenced pursuant

0004| to the provisions of Section 31-18-15 NMSA 1978.
|
0005| B. Any person who uses or attempts to use samples or DNA
|
0006| records for a purpose not authorized by the DNA Identification Act
|
0007| is guilty of a fourth degree felony and shall be sentenced
|
0008| pursuant to the provisions of Section 31-18-15 NMSA 1978.
|
0009| C. Any person who obtains or attempts to obtain samples
|
0010| or DNA records for a purpose not authorized by the DNA
|
0011| Identification Act is guilty of a fourth degree felony and shall
|
0012| be sentenced pursuant to the provisions of Section 31-18-15 NMSA
|
0013| 1978.
|
0014| Section 13. DNA FUND CREATED--PURPOSES.--
