0011| RELATING TO NURSING; EXTENDING THE REPORTING DEADLINE FOR THE
|
0012| MEDICATION AIDES PROGRAM.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 61-3-10.3 NMSA 1978 (being Laws 1995,
|
0016| Chapter 117, Section 1) is amended to read:
|
0017| "61-3-10.3. MEDICATION AIDES.--
|
0018| A. This section permits the operation of a trial
|
0019| program for certification of medication aides and medication
|
0020| aide training programs to serve income-eligible persons
|
0021| participating in the developmentally disabled medicaid waiver
|
0022| program. The purpose of the trial program is to effectuate a
|
0023| cost-containment and efficient program for the administration
|
0024| of the medicaid program. The trial program shall be evaluated
|
0025| by the board and a report of the results submitted to the first
|
0001| session of the [forty-third] forty-fourth legislature.
|
0002| B. The developmental disabilities division of the
|
0003| department of health shall, through contract or agreement,
|
0004| provide remuneration to developmental disabilities service
|
0005| providers and to medication aides for services rendered to
|
0006| medicaid waiver program participants. Developmental
|
0007| disabilities service providers shall, through contract or
|
0008| agreement, provide remuneration to the board for administrative
|
0009| and other costs associated with oversight of the medication
|
0010| aide program.
|
0011| C. For the purposes of this section, "medication
|
0012| aide" means a person who, under the supervision of a licensed
|
0013| nurse, is permitted to administer oral medications to
|
0014| participants in the developmentally disabled medicaid waiver
|
0015| program according to standards adopted by the board.
|
0016| D. Medication aides who serve participants in the
|
0017| developmentally disabled medicaid waiver program shall make
|
0018| application and obtain training and certification as provided
|
0019| in Section 61-3-10.2 NMSA 1978 and shall be subject to all
|
0020| other regulations pertaining to medication aides as determined
|
0021| by the board."
