0011| RELATING TO STATE EDUCATIONAL INSTITUTIONS; AMENDING A SECTION

0012| OF THE NMSA 1978 TO AUTHORIZE RESIDENT STUDENT STATUS FOR
|
0013| ATHLETIC SCHOLARSHIP RECIPIENTS.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 21-1-2 NMSA 1978 (being Laws 1970,
|
0017| Chapter 9, Section 1, as amended) is amended to read:
|
0018| "21-1-2. MATRICULATION AND TUITION FEES.--
|
0019| A. Except as otherwise provided in this section and
|
0020| in Section 21-1-4.3 NMSA 1978, the boards of regents of the
|
0021| university of New Mexico, New Mexico state university, New
|
0022| Mexico highlands university, western New Mexico university,
|
0023| eastern New Mexico university, New Mexico military institute,
|
0024| New Mexico institute of mining and technology and New Mexico
|
0025| junior college shall establish and charge matriculation fees
|
0001| and tuition fees as follows:
|
0002| (1) each student shall be charged a
|
0003| matriculation fee of not less than five dollars ($5.00) upon
|
0004| enrolling in each institution;
|
0005| (2) each student who is a resident of New
|
0006| Mexico shall be charged a tuition fee of not less than twenty
|
0007| dollars ($20.00) a year;
|
0008| (3) each student who is not a resident of New
|
0009| Mexico shall be charged a tuition fee of not less than fifty
|
0010| dollars ($50.00) a year;
|
0011| (4) each student shall be charged a tuition
|
0012| fee of not less than ten dollars ($10.00) for each summer
|
0013| session; and
|
0014| (5) each student may be charged a tuition fee
|
0015| for extension courses.
|
0016| B. Except as otherwise provided in this section and
|
0017| in Section 21-1-4.3 NMSA 1978, the board of regents of northern
|
0018| New Mexico state school shall establish and charge each student
|
0019| a matriculation fee and a tuition fee.
|
0020| C. The board of regents of each institution may
|
0021| establish and grant gratis scholarships to students who are
|
0022| residents of New Mexico in an amount not to exceed the
|
0023| matriculation fee or tuition and fees, or both. Except as
|
0024| provided in Section 21-1-4.3 NMSA 1978, the number of
|
0025| scholarships established and granted shall not exceed three
|
0001| percent of the preceding fall semester enrollment in each
|
0002| institution and shall not be established and granted for summer
|
0003| sessions. The president of each institution shall select and
|
0004| recommend to the board of regents of his institution, as
|
0005| recipients of scholarships, students who possess good moral
|
0006| character and satisfactory initiative, scholastic standing and
|
0007| personality. At least thirty-three and one-third percent of
|
0008| the gratis scholarships established and granted by each board
|
0009| of regents each year shall be granted on the basis of financial
|
0010| need.
|
0011| D. The board of regents of each institution set out
|
0012| in this subsection may establish and grant, in addition to
|
0013| those scholarships provided for in Subsection C of this
|
0014| section, athletic scholarships for tuition and fees. In no
|
0015| event shall the board of regents of any institution be allowed
|
0016| to award scholarships for tuition and fees for more than the
|
0017| number of athletic scholarships set out in this subsection and
|
0018| in no event shall more than seventy-five percent of the
|
0019| scholarships granted be for out-of-state residents:
|
0020| (1) the board of regents of the university of
|
0021| New Mexico may grant up to two hundred ninety-three athletic
|
0022| scholarships;
|
0023| (2) the board of regents of New Mexico state
|
0024| university may grant up to two hundred seventy athletic
|
0025| scholarships;
|
0001| (3) the boards of regents of New Mexico
|
0002| highlands university, eastern New Mexico university and western
|
0003| New Mexico university may each grant up to one hundred forty
|
0004| athletic scholarships; and
|
0005| (4) the board of regents of New Mexico junior
|
0006| college may grant up to fifty-two athletic scholarships.
|
0007| E. [Notwithstanding the provisions of Subsection D
|
0008| of this section, in computing tuition credits the commission on
|
0009| higher education shall accept the value of scholarships for
|
0010| tuition and fees established by the boards of regents of the
|
0011| university of New Mexico, New Mexico state university, eastern
|
0012| New Mexico university, western New Mexico university and New
|
0013| Mexico highlands university for athletes for the seventy-eighth
|
0014| fiscal year and all fiscal years thereafter. In no event shall
|
0015| the board of regents of any such institution be allowed to
|
0016| establish scholarships for tuition and fees for more than] In
|
0017| the event that the number of athletic scholarships exceeds the
|
0018| number of athletic scholarships permitted that institution by
|
0019| regulations and bylaws of the national collegiate athletic
|
0020| association or the national association of intercollegiate
|
0021| athletics of which that institution is a member, the
|
0022| appropriate board of regents shall reduce the number of
|
0023| authorized tuition scholarships to comply with association
|
0024| rules and regulations.
|
0025| F. Matriculation fees and tuition fees shall be
|
0001| fixed and made payable as directed by the board of regents of
|
0002| each institution, collected by the officers of each institution
|
0003| and accounted for as are other funds of the institutions.
|
0004| Matriculation fees shall be charged only once for each
|
0005| institution in which a student enrolls."
|
0006| Section 2. Section 21-1-3 NMSA 1978 (being Laws 1970,
|
0007| Chapter 47, Section 1, as amended) is amended to read:
|
0008| "21-1-3. STATE EDUCATIONAL INSTITUTIONS--RESIDENT
|
0009| STUDENTS.--
|
0010| A. For the purpose of tuition payment at the
|
0011| resident student rates at state educational institutions, as
|
0012| defined in Article 12, Section 11 of the constitution of New
|
0013| Mexico, "resident student" includes:
|
0014| (1) any person not otherwise entitled to claim
|
0015| residence who is a member of the armed forces of the United
|
0016| States assigned to active duty within the exterior boundaries
|
0017| of this state; and
|
0018| (2) the spouse or dependent child of any
|
0019| person who qualifies under Paragraph (1) of this subsection.
|
0020| B. Assignment to active duty within the exterior
|
0021| boundaries of this state may be established by a certificate of
|
0022| assignment from the commanding officer of the person so
|
0023| assigned.
|
0024| C. For the purpose of tuition payment at resident
|
0025| student rates at New Mexico highlands university, "resident
|
0001| student" may include any person who is a Native American and a
|
0002| citizen of the United States.
|
0003| D. For the purposes of tuition payment and budget
|
0004| and revenue calculations, the board of regents of any post-
|
0005| secondary, state educational institution, as defined in Article
|
0006| 12, Section 11 of the constitution of New Mexico, may determine
|
0007| that "resident student" includes any Texas resident who resides
|
0008| within a one hundred thirty-five mile radius of that
|
0009| institution.
|
0010| E. For the purpose of tuition payment and budget
|
0011| and revenue calculations, "resident student" includes any
|
0012| student receiving an athletic scholarship from a post-secondary
|
0013| educational institution set forth in Article 12, Section 11 of
|
0014| the constitution of New Mexico."
