0011| RELATING TO PUBLIC SCHOOLS; REQUIRING THE STATE DEPARTMENT OF

0012| PUBLIC EDUCATION TO ADOPT PROCEDURES TO ENSURE THAT SCHOOL

0013| DISTRICTS COMPLY WITH ACCOUNTING AND BUDGETING REGULATIONS;
|
0014| DIRECTING THE STATE DEPARTMENT OF PUBLIC EDUCATION TO
|
0015| PROMULGATE REGULATIONS REQUIRING SCHOOL DISTRICTS TO SUBMIT
|
0016| ANNUAL ACCOUNTING AND BUDGETING REPORTS.

0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0019| Section 1. Section 22-8-5 NMSA 1978 (being Laws 1967,
|
0020| Chapter 16, Section 59, as amended) is amended to read:
|
0021| "22-8-5. MANUAL OF ACCOUNTING AND BUDGETING.--
|
0022| A. The department shall compile and publish a
|
0023| manual prescribing detailed regulations for a uniform system of
|
0024| accounting and budgeting of funds for all public schools and
|
0025| school districts of the state. The manual of regulations and
|
0001| any revision or amendments thereto shall become effective only
|
0002| upon approval by the state board [of education] and the
|
0003| legislative finance committee, filing with the state records
|
0004| center and publication. A copy shall also be filed with the
|
0005| department of finance and administration.
|
0006| B. All public schools and school districts shall
|
0007| comply with the regulations prescribed in the manual of
|
0008| accounting and budgeting and shall, upon request, submit
|
0009| additional reports concerning finances to the department. In
|
0010| addition, upon request, all public schools and school districts
|
0011| shall file reports with the department containing pertinent
|
0012| details regarding applications for federal money or federal
|
0013| grants-in-aid or regarding federal money or federal grants-in-
|
0014| aid received, including but not limited to details of programs,
|
0015| matching funds, personnel requirements, salary provisions and
|
0016| program numbers, as indicated in the catalog of federal
|
0017| domestic assistance, of the federal funds applied for and of
|
0018| those received.

0019| C. The department shall develop procedures for
|
0020| ensuring that school districts comply with the regulations
|
0021| prescribed in the manual of accounting and budgeting. The
|
0022| department shall require school districts to submit annually a
|
0023| report on the district's internal control policies and
|
0024| procedures. The report shall be submitted with each budget
|
0025| request required pursuant to Section 22-8-12.1 NMSA 1978,
|
0001| include information on the internal control structure for all
|
0002| school district transactions and specify the individuals
|
0003| involved in the accounting and budgeting process during the
|
0004| accounting cycle.

0005| [C.] D. Upon request by the department of
|
0006| finance and administration, the legislative finance committee
|
0007| or the legislative education study committee, the [state]
|
0008| department [of public education] shall timely furnish
|
0009| information and data obtained from public schools and school
|
0010| districts pursuant to Subsection B of this section.
|
0011| Additionally, prior to the approval of temporary budgets, the
|
0012| department shall advise each school district and the state
|
0013| auditor of the minimum requirements for independent school
|
0014| district audits for the ensuing fiscal year.
