Section 66-8-116.3 NMSA 1978 (being Laws 1989, | 0017| Chapter 320, Section 5, as amended) is amended to read: | 0018| "66-8-116.3. PENALTY ASSESSMENT MISDEMEANORS--ADDITIONAL | 0019| FEES.--In addition to the penalty assessment established for | 0020| each penalty assessment misdemeanor, there shall be assessed: | 0021| A. ten dollars ($10.00) to help defray the costs of | 0022| local government corrections; | 0023| B. a court automation fee of ten dollars ($10.00); | 0024| C. a traffic safety fee of three dollars ($3.00), | 0025| which shall be credited to the traffic safety education and | 0001| enforcement fund; [and] | 0002| D. a judicial education fee of one dollar ($1.00), | 0003| which shall be credited to the judicial education fund; and | 0004| E. a brain injury services fee of five dollars | 0005| ($5.00), which shall be credited to the brain injury services | 0006| fund." | 0007| Section 2. Section 66-8-119 NMSA 1978 (being Laws 1968, | 0008| Chapter 62, Section 159, as amended) is amended to read: | 0009| "66-8-119. PENALTY ASSESSMENT REVENUE--DISPOSITION.-- | 0010| A. The division shall remit all penalty assessment | 0011| receipts, except receipts collected pursuant to Subsections A | 0012| through [D] E of Section 66-8-116.3 NMSA 1978, to the state | 0013| treasurer for credit to the general fund. | 0014| B. The division shall remit all penalty | 0015| assessment fee receipts collected pursuant to: | 0016| (1) Subsection A of Section 66-8-116.3 NMSA | 0017| 1978 to the state treasurer for credit to the local government | 0018| corrections fund; [the court automation fee collected pursuant | 0019| to] | 0020| (2) Subsection B of Section 66-8-116.3 NMSA | 0021| 1978 to the state treasurer for credit to the court automation | 0022| fund; [the traffic safety fee collected pursuant to] | 0023| (3) Subsection C of Section 66-8-116.3 NMSA | 0024| 1978 to the state treasurer for credit to the traffic safety | 0025| education and enforcement fund; [and the judicial education | 0001| fee collected pursuant to] | 0002| (4) Subsection D of Section 66-8-116.3 NMSA | 0003| 1978 to the state treasurer for credit to the judicial | 0004| education fund; and | 0005| (5) Subsection E of Section 66-8-116.3 NMSA | 0006| 1978 to the state treasurer for credit to the brain injury | 0007| services fund." | 0008| Section 3. [NEW MATERIAL] BRAIN INJURY SERVICES FUND | 0009| CREATED.-- | 0010| A. There is created in the state treasury the | 0011| "brain injury services fund". The fund shall be invested in | 0012| accordance with the provisions of Section 6-10-10 NMSA 1978, | 0013| and all income earned on the fund shall be credited to the | 0014| fund. | 0015| B. The brain injury services fund shall be used to | 0016| institute and maintain a statewide brain injury services | 0017| program designed to increase the independence of persons with | 0018| traumatic brain injuries. | 0019| C. The department of health shall adopt all rules, | 0020| regulations and policies necessary to administer a statewide | 0021| brain injury services program. The department of health shall | 0022| coordinate with and seek advice from the brain injury advisory | 0023| council to ensure that the statewide brain injury services | 0024| program is appropriate for persons with traumatic brain | 0025| injuries. | 0001| D. All money credited to the brain injury services | 0002| fund shall be appropriated to the department of health for the | 0003| purpose of carrying out the provisions of this section and | 0004| shall not revert to the general fund. | 0005| Section 4. Magistrate judges, including metropolitan court | 0001| judges, shall collect the following costs: | 0002| Docket fee, criminal actions under Section 29-5-1 NMSA | 0003| 1978. . . . . . . . . . . . . . . . . . . . . . . $ 1.00 | 0004| Docket fee, to be collected prior to docketing any other | 0005| criminal action, except as provided in Subsection B of | 0006| Section 35-6-3 NMSA 1978 . . . . . . . . . . . . . . 20.00 | 0007| Docket fee, ten dollars ($10.00) of which shall be | 0008| deposited in the court automation fund, to be collected | 0009| prior to docketing any civil action, except as provided | 0010| in Subsection A of Section 35-6-3 NMSA 1978. . . . . 47.00 | 0011| Jury fee, to be collected from the party demanding trial | 0012| by jury in any civil action at the time the demand is | 0013| filed or made. . . . . . . . . . . . . . . . . . . . 25.00 | 0014| Copying fee, for making and certifying copies of any | 0015| records in the court, for each page copied by | 0016| photographic process . . . . . . . . . . . . . . . . . .50 | 0017| Copying fee, for computer-generated or electronically | 0018| transferred copies, per page. . . . . . . . . . . . 1.00. | 0019| Proceeds from this copying fee shall be transferred to | 0020| the administrative office of the courts for deposit in | 0021| the court automation fund. Except as otherwise | 0022| specifically provided by law, docket fees shall be paid | 0023| into the general fund. | 0024| | 0025| | 0001| B. Except as otherwise provided by law, no other costs | 0002| or fees shall be charged or collected in the magistrate or | 0003| metropolitan court. | 0004| | 0005| C. The magistrate or metropolitan court may grant free | 0006| process to any party in any civil proceeding or special statutory | 0007| proceeding upon a proper showing of indigency. The magistrate or | 0008| metropolitan court may deny free process if it finds that the | 0009| complaint on its face does not state a cause of action. | 0010| | 0011| D. As used in this subsection, "convicted" means the | 0012| defendant has been found guilty of a criminal charge by the | 0013| magistrate or metropolitan judge, either after trial, a plea of | 0014| guilty or a plea of nolo contendere. Magistrate judges, | 0015| including metropolitan court judges, shall collect the following | 0016| costs: | 0017| | 0018| (1) corrections fee, to be collected upon | 0019| conviction from persons convicted of violating any provision of | 0020| the Motor Vehicle Code involving the operation of a motor | 0021| vehicle, convicted of a crime constituting a misdemeanor or a | 0022| petty misdemeanor or convicted of violating any ordinance that | 0023| may be enforced by the imposition of a term of imprisonment | 0024| . . . . . . . . . . . . . . . . . . . . . . . . . . $10.00; | 0025| | 0001| (2) court automation fee, to be collected upon | 0002| conviction from persons convicted of violating any provision of | 0003| the Motor Vehicle Code involving the operation of a motor | 0004| vehicle, convicted of a crime constituting a misdemeanor or a | 0005| petty misdemeanor or convicted of violating any ordinance that | 0006| may be enforced by the imposition of a term of | 0007| imprisonment . . . . . . . . . . . . . . . . . . . 10.00; | 0008| | 0009| (3) traffic safety fee, to be collected upon | 0010| conviction from persons convicted of violating any provision of | 0011| the Motor Vehicle Code involving the operation of a motor vehicle 3.00; | 0012| [and] | 0013| | 0014| | 0015| | 0016| | 0017| | 0018| | 0019| | 0020| | 0021| | 0022| (4) judicial education fee, to be collected upon | 0023| conviction from persons convicted of operating a motor vehicle in | 0024| violation of the Motor Vehicle Code, convicted of a crime | 0025| constituting a misdemeanor or a petty misdemeanor or convicted of | 0001| violating any ordinance punishable by a term of | 0002| imprisonment . . . . . . . . . . . . . . . . . . . . . . . 1.00; and | 0003| | 0004| (5) brain injury services fee, to be collected | 0005| upon conviction from persons convicted of violating any provision | 0006| of the Motor Vehicle Code involving the operation of a motor | 0007| vehicle. . . . . . . . . . . . . . . . . . . . . . . . . . . | 0008| 5.00. | 0009| | 0010| E.
