0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0017| Section 1. Section 3-12-1.1 NMSA 1978 (being Laws 1985,
|
0018| Chapter 203, Section 1, as amended) is amended to read:
|
0019| "3-12-1.1. ELECTION OF MEMBERS OF GOVERNING
|
0020| BODIES--REQUIRING RESIDENCY.--Except as provided in Section
|
0021| 3-12-2 NMSA 1978, members of governing bodies, excluding
|
0022| mayors, of municipalities having a population in excess of ten
|
0023| thousand shall reside in and be elected from single-member
|
0024| districts. If any member of the governing body permanently
|
0025| removes his residence from or maintains no residence in the
|
0001| district from which he was elected, he shall be deemed to have
|
0002| resigned. Once, following every federal decennial census, the
|
0003| governing body of the municipality shall divide the
|
0004| municipality into a number of districts equal to the number of
|
0005| members on the governing body. Such districts shall be compact
|
0006| and contiguous and composed of populations as nearly equal as
|
0007| practicable; provided that the governing body of [H class
|
0008| counties and of] any municipality having a population of ten
|
0009| thousand or less may provide for single-member districts as
|
0010| provided in this section."
