0011| CREATING A JOINT INTERIM LEGISLATIVE PUBLIC REGULATION
|
0012| COMMITTEE; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. PUBLIC REGULATION COMMITTEE CREATED--
|
0016| TERMINATION.--There is created a joint interim legislative
|
0017| committee which shall be known as the "public regulation
|
0018| committee". The committee shall function from the date of its
|
0019| appointment until the first day of December prior to the first
|
0020| session of the forty-fourth legislature.
|
0021| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0022| A. The public regulation committee shall be
|
0023| composed of ten members. Five members of the house of
|
0024| representatives shall be appointed by the speaker of the house
|
0025| of representatives, and five members of the senate shall be
|
0001| appointed by the committees' committee of the senate or, if the
|
0002| senate appointments are made in the interim, by the president
|
0003| pro tempore of the senate after consultation with and agreement
|
0004| of a majority of the members of the committees' committee.
|
0005| B. Members shall be appointed from each house so as
|
0006| to give the two major political parties in each house the same
|
0007| proportional representation on the committee as prevails in
|
0008| each house; however, in no event shall either party have less
|
0009| than one member from each house on the committee. Vacancies on
|
0010| the committee shall be filled by appointment in the same manner
|
0011| as the original appointments. The chairman and vice chairman
|
0012| of the committee shall be appointed by the speaker of the house
|
0013| of representatives and the president pro tempore of the senate.
|
0014| C. No action shall be taken by the committee if a
|
0015| majority of the total membership from either house on the
|
0016| committee rejects such action.
|
0017| Section 3. DUTIES.--After its appointment, the public
|
0018| regulation committee shall hold one organizational meeting to
|
0019| develop a work plan and budget for the ensuing interim. The
|
0020| work plan and budget shall be submitted to the New Mexico
|
0021| legislative council for approval. Upon approval of the work
|
0022| plan and budget by the legislative council, the committee shall
|
0023| examine the statutes, constitutional provisions, regulations
|
0024| and court decisions governing public utilities, corporations,
|
0025| transportation companies, transmission and pipeline companies,
|
0001| insurance companies and other matters related to the
|
0002| establishment and authority of the new public regulation
|
0003| commission and recommend legislation or changes if any are
|
0004| found to be necessary to the second session of the forty-third
|
0005| legislature and the first session of the forty-fourth
|
0006| legislature.
|
0007| Section 4. SUBCOMMITTEES.--Subcommittees shall be created
|
0008| only by majority vote of all members appointed to the public
|
0009| regulation committee and with the prior approval of the New
|
0010| Mexico legislative council. A subcommittee shall be composed
|
0011| of at least one member from the senate and one member from the
|
0012| house of representatives, and at least one member of the
|
0013| minority party shall be a member of the subcommittee. All
|
0014| meetings and expenditures of a subcommittee shall be approved
|
0015| by the full committee in advance of such meeting or
|
0016| expenditure, and the approval shall be shown in the minutes of
|
0017| the committee.
|
0018| Section 5. REPORT.--The public regulation committee shall
|
0019| make an annual report of its findings and recommendations for
|
0020| the consideration of the legislature. The report and suggested
|
0021| legislation shall be made available to the New Mexico
|
0022| legislative council on or before December 15 preceding each
|
0023| session.
|
0024| Section 6. STAFF.--The staff for the public regulation
|
0025| committee shall be provided by the legislative council service.
|
0001| Section 7. APPROPRIATION.--For the purpose of paying the
|
0002| salaries and expenses of the technical, legal, clerical and
|
0003| stenographic assistants, for necessary equipment and supplies
|
0004| used in carrying out the provisions of this act and for
|
0005| reimbursing the per diem and mileage expenses of the public
|
0006| regulation committee, there is appropriated to the legislative
|
0007| council service from the general fund the sum of one hundred
|
0008| thousand dollars ($100,000). All or any part of this
|
0009| appropriation may be expended in fiscal years 1997 through
|
0010| 1999, and any unexpended or unencumbered balance remaining at
|
0011| the end of fiscal year 1999 shall revert to the general fund.
|
0012| Payments from the appropriation shall be made upon vouchers
|
0013| signed by the director of the legislative council service or
|
0014| his authorized representative.
|
0015| Section 8. EMERGENCY.--It is necessary for the public
|
0016| peace, health and safety that this act take effect immediately.
