0011| RELATING TO PUBLIC SCHOOLS; PROVIDING REQUIREMENTS FOR GUIDANCE

0012| COUNSELORS.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. SHORT TITLE.--This act may be cited as the
|
0016| "Guidance Counselor Act".
|
0017| Section 2. PURPOSE OF ACT.--The purpose of the Guidance
|
0018| Counselor Act is to require public school guidance counselors
|
0019| to spend most of their work time at their public school working
|
0020| with the individual student to address academic and personal
|
0021| problems which interfere with student achievement or cause high
|
0022| truancy and drop-out rates.
|
0023| Section 3. DEFINITIONS.--As used in the Guidance
|
0024| Counselor Act:
|
0025| A. "guidance counselor" means a guidance counselor
|
0001| who provides counseling and non-counseling services in public
|
0002| schools;
|
0003| B. "counseling services" means the providing of
|
0004| counsel, advice, direction and assistance to individual
|
0005| students on school and personal matters that affect the
|
0006| student's academic achievement as well as those additional
|
0007| counseling services defined by the local school board; and
|
0008| C. "non-counseling services" are all other services
|
0009| in the public school performed by the guidance counselor which
|
0010| are not counseling services, such as classroom instruction.
|
0011| Section 4. REQUIREMENTS.--Guidance counselors shall spend
|
0012| eighty percent of their scheduled work time on providing
|
0013| counseling services to students at their public school. Non-
|
0014| counseling services may be performed by guidance counselors
|
0015| during that portion of their scheduled work time not required
|
0016| to be spent on counseling services.
|
0017| Section 5. LOCAL BOARDS AND SCHOOL PRINCIPALS.--Local
|
0018| school boards and school principals in the school district
|
0019| shall oversee and review the work assignments of the guidance
|
0020| counselors employed by their schools to assure compliance with
|
0021| the provisions of the Guidance Counselor Act.
