0012| LESSEE OR A SERVER EMPLOYED BY A LICENSEE OR LESSEE TO HAVE

0013| SUCCESSFULLY COMPLETED AN ALCOHOL SERVER EDUCATION PROGRAM;
|
0014| PROVIDING SANCTIONS; AMENDING A SECTION OF THE ALCOHOL SERVER
|
0015| EDUCATION ACT.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 60-6D-4 NMSA 1978 (being Laws 1993,
|
0019| Chapter 68, Section 31, as amended) is amended to read:
|
0020| "60-6D-4. ALCOHOL SERVER TRAINING--[REQUIRED FOR LICENSE
|
0021| RENEWAL]REQUIREMENT TO COMPLETE A PROGRAM--SANCTIONS FOR
|
0022| NONCOMPLIANCE.--[Beginning July 1, 1995, a licensee seeking
|
0023| renewal of a license shall submit to the department, as a
|
0024| condition of license renewal, proof that the licensee, his
|
0025| lessee and each server employed by the licensee or lessee
|
0001| during the prior licensing year have completed alcohol server
|
0002| programs certified by the alcohol server education advisory
|
0003| committee pursuant to provisions of the Liquor Control Act.]
|
0004| A. A licensee, his lessee or a server employed by
|
0005| the licensee or lessee shall have successfully completed a
|
0006| program certified by the alcohol server education advisory
|
0007| committee.
|
0008| B. A server shall provide a copy of the certificate
|
0009| attesting to his successful completion of a program to the
|
0010| licensee or lessee who employs him.
|
0011| C. During hours of employment on licensed premises,
|
0012| a licensee, his lessee or a server employed by the licensee or
|
0013| lessee shall be required to keep a certificate attesting to
|
0014| successful completion of a program on his person. If
|
0015| requested, he shall present the certificate to an inspector
|
0016| from the alcohol and gaming division of the regulation and
|
0017| licensing department or a special agent from the department of
|
0018| public safety conducting an inspection of the licensed
|
0019| premises.
|
0020| D. A licensee or lessee may lawfully terminate the
|
0021| employment of an individual he employs as a server who fails to
|
0022| comply with the provisions of Subsection A, B or C of this
|
0023| section.
|
0024| E. When a licensee or his lessee fails to comply
|
0025| with the provisions of Subsection A or C of this section, it is
|
0001| a violation of the Liquor Control Act."
|
0002| Section 2. EFFECTIVE DATE.--The effective date of the
|
0003| provisions of this act is July 1, 1997.
