0011|     RELATING TO PROFESSIONAL ATHLETIC CONTESTS; EXEMPTING LIVE

0012|     PROFESSIONAL BOXING CONTESTS HELD IN NEW MEXICO FROM THE

0013|     PRIVILEGE TAX FOR EXHIBITING LIVE PROFESSIONAL CONTESTS ON A
    |
0014|     CLOSED-CIRCUIT TELECAST OR MOTION PICTURE; AMENDING A SECTION
    |
0015|     OF THE PROFESSIONAL ATHLETIC COMPETITION ACT; DECLARING AN
    |
0016|     EMERGENCY.

0018|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0019|          Section 1.  Section 60-2A-26 NMSA 1978 (being Laws 1980,
    |
0020|     Chapter 90, Section 26, as amended) is amended to read:
    |
0021|          "60-2A-26.  PRIVILEGE TAX ON CLOSED-CIRCUIT TELECASTS OR
    |
0022|     MOTION PICTURES--REPORT TO COMMISSION.--
    |
0023|               A.  Any person who charges and receives an admission
    |
0024|     fee for exhibiting any live professional contest on a closed-
    |
0025|     circuit telecast or motion picture shall, within seventy-two
    |
0001|     hours after <s>[such]</s> <u>the</u> event, furnish to the commission a
    |
0002|     verified written report on a form prescribed by the commission
    |
0003|     showing the number of tickets sold and issued or sold or issued
    |
0004|     and the gross receipts <s>[therefor]</s> <u>for the exhibition</u>
    |
0005|     without any deductions.
    |
0006|               B.  There is imposed a tax upon the privilege of
    |
0007|     exhibiting for an admission fee any live professional contest,
    |
0008|     <u>except a live professional boxing contest held in New Mexico</u>,
    |
0009|     on a closed-circuit telecast or motion picture. <s>[a tax at]</s>
    |
0010|     The rate of <u>the tax imposed is</u> five percent of the gross
    |
0011|     receipts derived <s>[therefrom]</s> <u>from the exhibition</u>.
    |
0012|               C.  The privilege tax imposed in this section shall
    |
0013|     be administered, collected, enforced and the proceeds deposited
    |
0014|     as provided in Section <s>[60-2A-23]</s> <u>60-2A-24</u> NMSA 1978." 
    |
0015|          Section 2.  EMERGENCY.--It is necessary for the public
    |
0016|     peace, health and safety that this act take effect immediately.
