0011| RELATING TO MUNICIPAL HOUSING AUTHORITIES; PERMITTING A

0012| MUNICIPAL HOUSING AUTHORITY COMMISSIONER TO HOLD ANOTHER OFFICE

0013| OR EMPLOYMENT WITH THE CITY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 3-45-5 NMSA 1978 (being Laws 1965,
|
0017| Chapter 300, Section 14-46-5, as amended) is amended to read:
|
0018| "3-45-5. CREATION OF AUTHORITY.--
|
0019| A. Every city, in addition to other powers
|
0020| conferred by the Municipal Housing Law, shall have power and is
|
0021| [hereby] authorized, by proper resolution of its governing
|
0022| body, to create, as an agent of such city, an authority to be
|
0023| known as the "housing authority" of the city. The "housing
|
0024| authority" of the city may constitute a public body corporate.
|
0025| The city may delegate to such authority the power to construct,
|
0001| maintain, operate and manage any housing project or projects of
|
0002| the city and may delegate to the authority any or all of the
|
0003| powers conferred on the city by the Municipal Housing Law.
|
0004| B. When the governing body of a city adopts a
|
0005| resolution pursuant to Subsection A of this section, the mayor
|
0006| shall appoint five persons as commissioners of the authority
|
0007| created as agent for the city. The commissioners who are first
|
0008| appointed shall be designated to serve for terms of one, two,
|
0009| three, four and five years, respectively, from the date of
|
0010| their appointment, but thereafter, commissioners shall be
|
0011| appointed for a term of office of five years, except that all
|
0012| vacancies shall be filled for the unexpired term. [A
|
0013| commissioner of an authority shall not hold any other office or
|
0014| employment of the city for which the authority is created.] A
|
0015| commissioner shall hold office until his successor has been
|
0016| appointed and has qualified, unless sooner removed according to
|
0017| law. A commissioner may serve two or more successive terms of
|
0018| office. A certificate of the appointment or reappointment of
|
0019| any commissioner shall be filed with the clerk, and the cer-
|
0020|
|
0021| tificate shall be conclusive evidence of the due and proper
|
0022| appointment of such commissioner. A commissioner shall receive
|
0023| no compensation for his services for the authority in any
|
0024| capacity, but he shall be entitled to the necessary expenses,
|
0025| including traveling expenses, incurred in the discharge of his
|
0001| duties.
|
0002| C. Any powers delegated by a city to an authority
|
0003| shall be vested in the commissioners of the authority in office
|
0004| from time to time. Three commissioners shall constitute a
|
0005| quorum of the authority for the purpose of conducting its
|
0006| business and exercising its powers and for all other purposes.
|
0007| Action may be taken by the authority upon a vote of a majority
|
0008| of the commissioners present. The commission shall organize
|
0009| itself at its annual meeting each even-numbered year. Any city
|
0010| creating a housing authority may authorize the authority to
|
0011| employ a secretary, who shall be executive director and who
|
0012| shall be removable only for cause, technical experts and such
|
0013| other officers, attorneys, agents and employees, permanent and
|
0014| temporary, as the authority may require; to determine their
|
0015| qualifications, duties and compensation; and to delegate to one
|
0016| or more of them such powers or duties as the authority may deem
|
0017| proper."
