GONZALES | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING FUNDING FROM | 0012| SEVERANCE TAX BONDS AND OTHER SOURCES FOR CAPITAL PROJECTS IN | 0013| HOUSE DISTRICT 42 LOCATED IN TAOS COUNTY; EXPANDING THE PURPOSE | 0014| OF A 1994 AUTHORIZATION; MAKING APPROPRIATIONS; DECLARING AN | 0015| EMERGENCY. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0019| APPROPRIATION OF PROCEEDS.-- | 0020| A. The state board of finance may issue and sell | 0021| severance tax bonds in compliance with the Severance Tax | 0022| Bonding Act in an amount not to exceed the total of the amounts | 0023| authorized for the purposes specified in this section. The | 0024| state board of finance shall schedule the issuance and sale of | 0025| the bonds in the most expeditious and economical manner | 0001| possible upon a finding by the board that the project has been | 0002| developed sufficiently to justify the issuance and that the | 0003| project can proceed to contract within a reasonable time. The | 0004| state board of finance shall further take the appropriate steps | 0005| necessary to comply with the Internal Revenue Code of 1986, as | 0006| amended. Proceeds from the sale of the bonds are appropriated | 0007| for the purposes specified in this section. The agencies named | 0008| in this section shall certify to the state board of finance | 0009| when the money from the proceeds of the severance tax bonds | 0010| authorized in this section is needed for the purposes specified | 0011| in the applicable subsection of this section. Appropriation of | 0012| the proceeds for each purpose is subject to the limitations, | 0013| when applicable, provided for in this act. If the specified | 0014| agency has not certified the need for the issuance of the bonds | 0015| by the end of fiscal year 1999, the authorization provided in | 0016| this act shall be void. Unless otherwise specified in this | 0017| act, any unexpended or unencumbered balance remaining from the | 0018| proceeds of severance tax bonds issued pursuant to this section | 0019| at the end of fiscal year 2000 shall revert to the severance | 0020| tax bonding fund. | 0021| B. Upon certification by the state agency on aging, | 0022| one hundred thousand dollars ($100,000) is appropriated to the | 0023| state agency on aging to renovate the Taos pueblo senior | 0024| citizen center in Taos county. | 0025| C. Upon certification by the state department of | 0001| public education, the following amounts are appropriated to the | 0002| department for the following purposes in Taos county: | 0003| (1) eight hundred thousand dollars ($800,000) | 0004| to complete the construction, equipping and furnishing of | 0005| phases one and two of the lecture hall, music classroom and | 0006| media center capital project of the Mesa Vista consolidated | 0007| school district; | 0008| (2) one hundred twenty-five thousand dollars | 0009| ($125,000) for districtwide library acquisitions for the Mesa | 0010| Vista consolidated school district; | 0011| (3) eighty thousand dollars ($80,000) for | 0012| heating and ventilation improvements to the Penasco high school | 0013| and elementary school buildings; | 0014| (4) one hundred twenty-five thousand dollars | 0015| ($125,000) to reroof the Penasco high school and middle school | 0016| buildings; | 0017| (5) one hundred thousand dollars ($100,000) to | 0018| purchase and install liquefied petroleum gas tanks and improve | 0019| the piping system for Penasco independent school district; | 0020| (6) seven hundred seventy-eight thousand | 0021| dollars ($778,000) to renovate the library, cafeteria area, | 0022| restrooms and classrooms at Questa elementary school; and | 0023| (7) three hundred fifty thousand dollars | 0024| ($350,000) to design and construct four recreation fields and | 0025| related facilities for Taos municipal schools. | 0001| D. Upon certification by the state engineer, seven | 0002| thousand five hundred dollars ($7,500) is appropriated to the | 0003| office of the state engineer for improvements to the San | 0004| Cristobal irrigation reservoir of the San Cristobal ditch | 0005| association in Taos county. | 0006| E. Upon certification by the department of | 0007| environment, the following amounts are appropriated to the | 0008| department for the following purposes in Taos county: | 0009| (1) twenty-five thousand dollars ($25,000) to | 0010| complete the water system project of the upper Arroyo Hondo | 0011| domestic water association; | 0012| (2) forty thousand dollars ($40,000) to plan, | 0013| develop and construct a water system for the Canon mutual | 0014| domestic water association; | 0015| (3) one hundred thousand dollars ($100,000) | 0016| for a water hydrology study and to drill a well to start a | 0017| community water system for the El Rito mutual domestic water | 0018| consumers and sewer association; | 0019| (4) two hundred thousand dollars ($200,000) | 0020| for an additional water storage tank for the El Prado water and | 0021| sanitation district; | 0022| (5) one hundred thousand dollars ($100,000) | 0023| for a feasibility study for water and wastewater systems in El | 0024| Valle de Los Ranchos sanitation district; | 0025| (6) six hundred forty-seven thousand dollars | 0001| ($647,000) for water system improvements for La Lama mutual | 0002| domestic water consumers association; | 0003| (7) twenty-five thousand dollars ($25,000) for | 0004| a joint water feasibility study for Penasco, Rodarte and Rio | 0005| Lucio; | 0006| (8) two hundred fifty thousand dollars | 0007| ($250,000) to replace the water storage tank in Penasco; and | 0008| (9) seventy-five thousand dollars ($75,000) to | 0009| construct a domestic water well for Questa. | 0010| F. Upon certification by the state highway and | 0011| transportation department, the following amounts are | 0012| appropriated to the department for the following purposes in | 0013| Taos county: | 0014| (1) one hundred thousand dollars ($100,000) to | 0015| resurface and improve Santa Barbara road; | 0016| (2) one hundred twenty-five thousand dollars | 0017| ($125,000) to complete phase three of the Vallejos road | 0018| project, county road B-060; | 0019| (3) two hundred forty thousand dollars | 0020| ($240,000) to complete phases one and two of the Cuchilla road- | 0021| west Romero road loop project, county roads C-091 and C-087; | 0022| (4) one hundred seventy-five thousand dollars | 0023| ($175,000) to improve lower Las Colonias road, county road | 0024| A-008; and | 0025| (5) one hundred seventy-five thousand dollars | 0001| ($175,000) for design, archaeological services, right-of-way | 0002| acquisition and construction of Blueberry Hill road. | 0003| G. Upon certification by the local government | 0004| division of the department of finance and administration, the | 0005| following amounts are appropriated to the local government | 0006| division for the following purposes in Taos county: | 0007| (1) one hundred thousand dollars ($100,000) to | 0008| plan, design, construct and equip a community and firehouse | 0009| facility for the community of La Lama; | 0010| (2) fifty thousand dollars ($50,000) to | 0011| design, construct and equip a road department substation in | 0012| Penasco; | 0013| (3) for the village of Red River: | 0014| (a) five hundred thousand dollars | 0015| ($500,000) to design and construct a multipurpose building; and | 0016| (b) one hundred fifty thousand dollars | 0017| ($150,000) to acquire the "little red school house" building | 0018| from the Questa independent school district; | 0019| (4) for the village of Questa: | 0020| (a) one hundred fifty thousand dollars | 0021| ($150,000) to renovate the old senior citizen building to serve | 0022| as a community multipurpose building; | 0023| (b) one hundred five thousand dollars | 0024| ($105,000) to construct a public works maintenance and shop | 0025| building; | 0001| (c) seventy-five thousand dollars | 0002| ($75,000) to construct a pavilion and restrooms and make water | 0003| improvements to the Molycorp Miner memorial park; | 0004| (d) twenty-five thousand dollars | 0005| ($25,000) to acquire and install computer equipment and | 0006| software for village offices; | 0007| (e) fifty thousand dollars ($50,000) to | 0008| match a community development block grant to acquire water | 0009| rights for Questa; | 0010| (f) fifty thousand dollars ($50,000) to | 0011| design, construct and equip a road substation; and | 0012| (g) twenty-five thousand dollars | 0013| ($25,000) to construct and maintain an additional FM translator | 0014| station; | 0015| (5) three hundred fifty thousand dollars | 0016| ($350,000) to construct and equip a youth and family center for | 0017| the town of Taos; | 0018| (6) for the county of Taos: | 0019| (a) two hundred fifty thousand dollars | 0020| ($250,000) to plan and design an adult and juvenile detention | 0021| facility; | 0022| (b) two hundred thousand dollars | 0023| ($200,000) to construct, equip and furnish a public health | 0024| office; and | 0025| (c) seventy-five thousand dollars | 0001| ($75,000) to purchase three sheriff's department vehicles; and | 0002| (7) two hundred thousand dollars ($200,000) | 0003| for the county to develop a master plan for community centers. | 0004| H. Upon certification by the property control | 0005| division of the general services department, three hundred | 0006| twenty-five thousand dollars ($325,000) is appropriated to the | 0007| capital program fund to construct, equip and furnish an | 0008| addition to the Taos counseling and detoxification center in | 0009| Taos county. | 0010| I. Upon certification by the board of regents of | 0011| the university of New Mexico, fifty thousand dollars ($50,000) | 0012| is appropriated to the board of regents for vocational | 0013| equipment and T-1 communications line equipment at the Taos | 0014| center of the university of New Mexico in Taos county. | 0015| Section 2. APPROPRIATION--IRRIGATION WORKS CONSTRUCTION | 0016| FUND.--Eleven thousand dollars ($11,000) is appropriated from | 0017| the irrigation works construction fund to the interstate stream | 0018| commission for expenditure in fiscal years 1997 and 1998 for | 0019| the Saucito ditch dam diversion rehabilitation project. Any | 0020| unexpended or unencumbered balance remaining at the end of | 0021| fiscal year 1998 shall revert to the irrigation works | 0022| construction fund. | 0023| Section 3. SEVERANCE TAX BONDS--EXPANSION OF PURPOSE-- | 0024| REAPPROPRIATION OF BALANCES.--Nineteen thousand five hundred | 0025| thirty-four dollars ($19,534) remaining of the proceeds of the | 0001| sale of severance tax bonds authorized in Paragraph (30) of | 0002| Subsection B of Section 49 of Chapter 148 of Laws 1994 to | 0003| acquire land for a community fire station in Chamisal in Taos | 0004| county is reappropriated to the local government division of | 0005| the department of finance and administration to plan, design, | 0006| construct and equip the Chamisal fire substation. | 0007| Section 4. EMERGENCY.--It is necessary for the public | 0008| peace, health and safety that this act take effect immediately. | 0009|  |
