0011|     RELATING TO WATER CONSERVATION; ENACTING SECTIONS OF THE NMSA

0012|     1978 TO DEFINE BENEFICIAL USE TO INCLUDE WATER RIGHTS

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of Chapter 72 NMSA 1978 is
    |
0017|     enacted to read:
    |
0018|          "[<u>NEW MATERIAL</u>]  BENEFICIAL USE INCLUDES WATER RIGHTS
    |
0019|     CONSERVATION.--
    |
0020|               A.  As used in Chapter 72 NMSA 1978, "beneficial
    |
0021|     use" includes water rights conservation.  "Water rights
    |
0022|     conservation" means the reduction in amount of diversion or use
    |
0023|     of a water right, declared, permitted or adjudicated in
    |
0024|     accordance with the laws of this state, to divert and
    |
0025|     beneficially use water for purposes other than conservation.
    |
0001|               B.  Water rights conservation includes use of:
    |
0002|                    (1)  irrigation systems designed to maximize
    |
0003|     water use efficiency of plants; 
    |
0004|                    (2)  devices to maximize water use efficiency
    |
0005|     of domestic and commercial bathroom and kitchen appliances and
    |
0006|     plumbing; or 
    |
0007|                    (3)  southwest native and desert-adapted plant
    |
0008|     species for landscaping or commercial crop production."

0005|        1.  On page 1, line 23, after "right" strike the comma and
    |
0006|   insert in lieu thereof "that has been previously".

0008|        2.  On page 1, lines 24 and 25, strike "for purposes other
    |
0009|   than" and insert in lieu thereof "prior to institution of".
    |

0011|        3.  On page 1, line 25, after "conservation" insert
    |
0012|   "measures".
    |

    |
0014|        4.  On page 2, line 8, strike the quotation mark and between
    |
0015|   lines 8 and 9, insert the following new subsection:

0017|             "C.  Nothing in this section shall be construed to
    |
0018|   reinstate water rights that have been forfeited or abandoned
    |
0019|   prior to the effective date of this section."".,

0021|   and thence referred to the JUDICIARY COMMITTEE.
