Section 66-7-413.3 NMSA 1978 (being Laws 1991, | 0017| Chapter 227, Section 1) is amended to read: | 0018| "66-7-413.3. PERMITS FOR EXCESSIVE WEIGHT.-- | 0019| A. In addition to the authorization granted in | 0020| Section 66-7-413 NMSA 1978, special permits may be issued by | 0021| the motor transportation division for a single trip or for a | 0022| year. The fee for the permits shall be thirty-five dollars | 0023| ($35.00) for a single-trip permit and one hundred twenty | 0024| dollars ($120) for an annual permit. The permits authorized in | 0025| this section shall allow for an increase in axle weight over | 0001| the limit established in Section 66-7-409 NMSA 1978 ~~[subject~~ | 0002| ~~to the following: (1)]~~; provided, the increased axle weight | 0003| for liquid hauling tank vehicles that would otherwise haul less | 0004| than a full tank shall not exceed twenty-five percent of the | 0005| statutory authorized maximum weight. | 0006| B. The increased front axle weight of three-axle | 0007| solid waste collection vehicles shall not exceed eighteen | 0008| percent of the authorized maximum weight for the front axle of | 0009| the vehicle. | 0010| ~~[B.]~~ C. The special permits authorized by this | 0011| section shall not be valid for transportation of excessive | 0012| weights on the interstate system as currently defined in | 0013| federal law or as that system may be defined in the future. No | 0014| special permit issued pursuant to this section shall be valid | 0015| for gross vehicle weights in excess of eighty-six thousand four | 0016| hundred pounds or for any combination vehicle. | 0017| ~~[C.]~~ D. If the federal highway administration | 0018| of the United States department of transportation gives | 0019| ~~[offical]~~ official notice that money will be withheld or | 0020| that this section violates the grandfather provision of Title | 0021| 23, U.S.C. Section 127, the secretary may withdraw all special | 0022| permits and discontinue issuance of all special permits | 0023| authorized in this section until such time that final | 0024| determination is made. If the final determination allows the | 0025| state to issue the special permits without sanction of funds or | 0001| weight tables, then the secretary shall reissue the special | 0002| permits previously withdrawn and make the special permits | 0003| available pursuant to this section. | 0004| ~~[D.]~~ E. Any fees collected pursuant to special | 0005| permits authorizing over-size or over-weight transportation on | 0006| ~~[the]~~ state ~~[highway]~~ highways shall be collected for the | 0007| state highway and transportation department to be transferred | 0008| to the state road fund. Transfers shall be made on or before | 0009| the tenth day of the month following collection. | 0010| ~~[E.]~~ F.
