0011| RELATING TO CRIMINAL LAW; CREATING THE CRIMINAL OFFENSE OF

0012| AGGRAVATED EVADING OF AN OFFICER; ENACTING A NEW SECTION OF THE
|
0013| NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new Section 30-22-1.1 NMSA 1978 is enacted
|
0017| to read:
|
0018| "30-22-1.1. [NEW MATERIAL] AGGRAVATED EVADING OF AN
|
0019| OFFICER.--
|
0020| A. Aggravated evading of an officer consists of
|
0021| willfully refusing to bring a motor vehicle to a stop when
|
0022| given a visual or audible signal to stop, whether by hand,
|
0023| voice, emergency light, flashing light, siren or other signal,
|
0024| by a uniformed officer in an appropriately marked police
|
0025| vehicle and then driving the fleeing motor vehicle in a
|
0001| reckless manner that jeopardizes the safety of:
|
0002| (1) the general public;
|
0003| (2) the person driving the fleeing motor
|
0004| vehicle or any occupants in his motor vehicle; or
|
0005| (3) the officer seeking to stop the fleeing
|
0006| motor vehicle.
|
0007| B. Whoever commits aggravated evading of an officer
|
0008| is guilty of a fourth degree felony."
|
0009| Section 2. EFFECTIVE DATE.--The effective date of the
|
0010| provisions of this act is July 1, 1997.

0006| insert in lieu thereof "the intentional refusal".

0008| 2. On page 1, line 23, strike the third occurrence of a
|
0009| comma.
|

0011| 3. On page 1, strike line 25 in its entirety and insert in
|
0012| lieu thereof "the reckless driving of a motor vehicle with the
|
0013| intention of fleeing from a uniformed officer in pursuit of the
|
0014| vehicle and endangering".

0016| 4. On page 2, line 1, strike "jeopardizes".

0018| 5. On page 2, strike lines 2 through 6 in their entirety
|
0019| and insert in lieu thereof the following:

0021| "(1) an officer in pursuit of the fleeing

0022| vehicle;
|
0023|
|
0024| (2) a pedestrian in the immediate vicinity of
|
0025| the fleeing vehicle; or
|
0001|
|
0002| (3) the occupants of any other vehicle in the
|
0003| immediate vicinity of the fleeing vehicle.".,

0005| and thence referred to the APPROPRIATIONS AND FINANCE
|
0006| COMMITTEE.
