0011| RELATING TO DOMESTIC AFFAIRS; AUTHORIZING FEDERAL JUDGES,

0012| JUSTICES AND MAGISTRATES TO SOLEMNIZE CONTRACTS OF MARRIAGE;

0013| AMENDING A SECTION OF THE NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016| Section 1. Section 40-1-2 NMSA 1978 (being Laws 1859-
|
0017| 1860, p. 120, as amended) is amended to read:
|
0018| "40-1-2. CLERGYMEN OR CIVIL MAGISTRATES MAY SOLEMNIZE--
|
0019| FEES.--
|
0020| A. It is lawful, valid and binding to all intents
|
0021| and purposes for those who may so desire to solemnize the
|
0022| contract of matrimony by means of any ordained clergyman or
|
0023| authorized representative of a federally recognized Indian
|
0024| tribe, without regard to the sect to which he may belong or the
|
0025| rites and customs he may practice.

0001| B. Judges, justices and magistrates of any of the
|
0002| courts established by the constitution of the United States
|
0003| and laws of the United States or established by the
|
0004| constitution of New Mexico and laws of the state are civil
|
0005| magistrates having authority to solemnize contracts of
|
0006| matrimony.
|
0007| C. Civil magistrates solemnizing contracts of
|
0008| matrimony shall charge no fee therefor."
