MALLORY | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0012| SEVERANCE TAX BONDS FOR CAPITAL OUTLAY PROJECTS LOCATED IN QUAY | 0013| COUNTY; MAKING APPROPRIATIONS; DECLARING AN EMERGENCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0017| APPROPRIATION OF PROCEEDS.-- | 0018| A. The state board of finance may issue and sell | 0019| severance tax bonds in compliance with the Severance Tax | 0020| Bonding Act in an amount not to exceed the total of the amounts | 0021| authorized for purposes specified in Sections 2 through 6 of | 0022| this act. The state board of finance shall schedule the | 0023| issuance and sale of the bonds in the most expeditious and | 0024| economical manner possible upon a finding by the board that the | 0025| project has been developed sufficiently to justify the issuance | 0001| and that the project can proceed to contract within a | 0002| reasonable time. The state board of finance shall further take | 0003| the appropriate steps necessary to comply with the Internal | 0004| Revenue Code of 1986, as amended. Proceeds from the sale of | 0005| the bonds are appropriated for the purposes specified in | 0006| Sections 2 through 6 of this act. | 0007| B. The agencies named in Sections 2 through 6 of | 0008| this act shall certify to the state board of finance when the | 0009| money from the proceeds of the severance tax bonds authorized | 0010| in this section is needed for the purposes specified in the | 0011| applicable section of this act. | 0012| C. If the specified agency has not certified the | 0013| need for the issuance of the bonds by the end of fiscal year | 0014| 1999, the authorization provided in this act shall be void. | 0015| D. Unless otherwise specified in this act, any | 0016| unexpended or unencumbered balance remaining from the proceeds | 0017| of severance tax bonds issued pursuant to Sections 2 through 6 | 0018| of this act at the end of fiscal year 2000 shall revert to the | 0019| severance tax bonding fund. | 0020| Section 2. SEVERANCE TAX BONDS--STATE AGENCY ON AGING-- | 0021| PURPOSES.--Pursuant to the provisions of Section 1 of this act, | 0022| upon certification by the state agency on aging that the need | 0023| exists for the issuance of the bonds, the following amounts are | 0024| appropriated to the state agency on aging for the following | 0025| purposes: | 0001| A. one hundred thousand dollars ($100,000) to | 0002| design, construct, furnish or equip a recreation center for the | 0003| Logan senior center located in Quay county; and | 0004| B. two hundred forty thousand dollars ($240,000) to | 0005| design, construct, furnish and equip a senior citizen building | 0006| in San Jon located in Quay county. | 0007| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0008| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of | 0009| Section 1 of this act, upon certification by the local | 0010| government division of the department of finance and | 0011| administration that the need exists for the issuance of the | 0012| bonds, the following amounts are appropriated to the local | 0013| government division of the department of finance and | 0014| administration for the following purposes: | 0015| A. one hundred thousand dollars ($100,000) to | 0016| construct an addition to the existing Logan city hall for a | 0017| police station located in Quay county; | 0018| B. three hundred seventy thousand dollars | 0019| ($370,000) to purchase a fifty-five foot aerial truck with a | 0020| one thousand two hundred fifty gallons-per-minute pump for the | 0021| city of Tucumcari fire department in Quay county; | 0022| C. eighty thousand dollars ($80,000) for | 0023| architectural and engineering services for a new public safety | 0024| building in Tucumcari in Quay county; | 0025| D. ten thousand dollars ($10,000) to design and | 0001| construct repairs to the roof at the juvenile facility in | 0002| Tucumcari in Quay county; and | 0003| E. fifty thousand dollars ($50,000) to purchase | 0004| equipment for the town of Logan health clinic in Quay county. | 0005| Section 4. SEVERANCE TAX BONDS--STATE HIGHWAY AND | 0006| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the | 0007| provisions of Section 1 of this act, upon certification by the | 0008| state highway and transportation department that the need | 0009| exists for the issuance of the bonds, the following amounts are | 0010| appropriated to the state highway and transportation department | 0011| for the following purposes: | 0012| A. one hundred fifty thousand dollars ($150,000) to | 0013| design and construct improvements to Quay road AF in Quay | 0014| county; and | 0015| B. three hundred eighty-eight thousand dollars | 0016| ($388,000) to design and construct a facility for flood relief | 0017| for the Seventh, Eighth, Charles and Evans streets area, | 0018| including a retention pond, in Tucumcari in Quay county. | 0019| Section 5. SEVERANCE TAX BONDS--DEPARTMENT OF ENVIRONMENT- | 0020| -PURPOSES.--Pursuant to the provisions of Section 1 of this | 0021| act, upon certification by the department of environment that | 0022| the need exists for the issuance of the bonds, one million six | 0023| hundred forty-seven thousand dollars ($1,647,000) is | 0024| appropriated to the department of environment to close the | 0025| solid waste facility in Tucumcari in Quay county. | 0001| Section 6. SEVERANCE TAX BONDS--STATE DEPARTMENT OF | 0002| PUBLIC EDUCATION--PURPOSE.--Pursuant to the provisions of | 0003| Section 1 of this act, upon certification by the state | 0004| department of public education that the need exists for the | 0005| issuance of the bonds, ten thousand dollars ($10,000) is | 0006| appropriated to the state department of public education for | 0007| the purpose of purchasing and installing new computer hardware | 0008| or software in the House school district located in Quay | 0009| county. | 0010| Section 7. EMERGENCY.--It is necessary for the public | 0011| peace, health and safety that this act take effect immediately. | 0012|  |
