0011|     RELATING TO INSURANCE; AUTHORIZING PAYMENT TO DOCTORS OF

0012|     ORIENTAL MEDICINE BY INSURERS OFFERING MEDICAL PAYMENTS AS PART
    |
0013|     OF VEHICLE COVERAGE; ENACTING A NEW SECTION OF THE NMSA 1978.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of Article 32 of the New Mexico
    |
0017|     Insurance Code is enacted to read:
    |
0018|          "[<u>NEW MATERIAL</u>]  FREEDOM OF CHOICE--DOCTOR OF ORIENTAL
    |
0019|     MEDICINE.--
    |
0020|               A.  Within the area and limits of coverage offered
    |
0021|     an insured and selected by him in the application for
    |
0022|     insurance, for vehicle insurance medical payments as defined in
    |
0023|     Subsection D of Section 59A-7-7 NMSA 1978, the right of any
    |
0024|     person to exercise full freedom of choice in the selection of
    |
0025|     any licensed doctor of oriental medicine for treatment within
    |
0001|     his scope of practice shall not be restricted under any new
    |
0002|     policy of vehicle insurance issued after July 1, 1997 in this
    |
0003|     state or in the processing of any claim made pursuant to that
    |
0004|     policy.  Any person insured or claiming benefits under the
    |
0005|     medical payments portion of such vehicle insurance policy
    |
0006|     providing within its coverage for payment of benefits or
    |
0007|     indemnity for any condition or circumstance described in
    |

0008|     Subsection D of Section 59A-7-7 NMSA 1978 shall be deemed to
    |
0009|     have complied with the requirements of the policy as to
    |
0010|     submission of proof of loss upon submitting written proof
    |
0011|     supported by any doctor of oriental medicine.
    |
0012|               B.  As used in this section, "doctor of oriental
    |
0013|     medicine" means a person licensed as a doctor of oriental
    |
0014|     medicine pursuant to the Acupuncture and Oriental Medicine
    |
0015|     Practice Act."
