0011|     RELATING TO HEALTH; REQUIRING HEPATITIS-B IMMUNIZATION AS A

0012|     CONDITION OF ENTRANCE TO SCHOOL.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 24-5-2 NMSA 1978 (being Laws 1959,
    |
0016|     Chapter 329, Section 2, as amended) is amended to read:
    |
0017|          "24-5-2.  UNLAWFUL TO ENROLL IN SCHOOL UNIMMUNIZED--
    |
0018|     UNLAWFUL TO REFUSE TO PERMIT IMMUNIZATION.--It is unlawful for
    |
0019|     any student to enroll in school unless he has been immunized as
    |
0020|     required under the rules and regulations of the health services
    |
0021|     division of the <u>department of</u> health <s>[and environment
</s>    |
<s></s>0022| <s>    department]</s><u></u> and can provide satisfactory evidence of such
    |
0023|     immunization, <u>including immunization against hepatitis-B</u>. 
    |
0024|     <s>[Provided that]</s> If he produces satisfactory evidence of
    |
0025|     having begun the process of immunization, he may enroll and
    |
0001|     attend school as long as the immunization process is being
    |
0002|     accomplished in the prescribed manner.  It is unlawful for any
    |
0003|     parent to refuse or neglect to have his child immunized, as
    |
0004|     required by this section, unless the child is properly
    |
0005|     exempted."
