0011|     RELATING TO COUNTIES; INCREASING THE MEMBERS OF COUNTY PLANNING

0012|     COMMISSIONS IN CERTAIN CLASS A COUNTIES.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 4-57-1 NMSA 1978 (being Laws 1967,
    |
0016|     Chapter 150, Section 1) is amended to read:
    |
0017|          "4-57-1.  CREATION OF PLANNING COMMISSION.--
    |
0018|               <u>A.</u>  Any county may by ordinance establish a
    |
0019|     planning commission. <u>Except as provided in Subsection B of
</u>    |
<u></u>0020| <u>    this section</u>, a county planning commission shall consist of
    |
0021|     not less than five <s>[(5)]</s> members who shall be appointed by
    |
0022|     the <u>board of</u> county <s>[commission]</s> <u>commissioners</u>. 
    |
0023|     Administrative officials of the county may be appointed as ex-
    |
0024|     officio nonvoting members of the planning commission.
    |
0025|               <u>B.  The planning commission of a class A county
</u>    |
<u></u>0001| <u>    with a population over two hundred thousand as determined in
</u>    |
<u></u>0002| <u>    the most recent federal decennial census shall consist of
</u>    |
<u></u>0003| <u>    fifteen members.  Each county commissioner shall appoint three
</u>    |
<u></u>0004| <u>    members from his district.</u>"
    |
0005|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0006|     provisions of this act is July 1, 1997.
