0011| RELATING TO THE VOLUNTEER FIREFIGHTERS RETIREMENT FUND;

0012| AMENDING CERTAIN SECTIONS OF THE NMSA 1978 TO INCREASE FUNDING
|
0013| AND ALTER METHODS OF FILING SERVICE CREDITS; MAKING AN
|
0014| APPROPRIATION.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 10-11A-3 NMSA 1978 (being Laws 1983,
|
0018| Chapter 263, Section 3, as amended) is amended to read:
|
0019| "10-11A-3. VOLUNTEER FIREFIGHTERS RETIREMENT FUND--
|
0020| CREATION--TRANSFER OF FUNDS FROM THE FIRE PROTECTION FUND.--
|
0021| A. There is created the "volunteer firefighters
|
0022| retirement fund" in the state treasury. All annuities and
|
0023| benefits in lieu of annuities shall be paid from the fund as
|
0024| provided in the Volunteer Firefighters Retirement Act.
|
0025| B. Beginning in fiscal year [1997] 1998, the
|
0001| state treasurer shall transfer annually on or before the last
|
0002| day of July [seven hundred fifty thousand dollars ($750,000)]
|
0003| two million one hundred thousand dollars ($2,100,000) from
|
0004| the [general] fire protection fund to the credit of the
|
0005| volunteer firefighters retirement fund."
|
0006| Section 2. Section 10-11A-6 NMSA 1978 (being Laws 1983,
|
0007| Chapter 263, Section 6) is amended to read:
|
0008| "10-11A-6. DETERMINATION OF SERVICE CREDIT.--
|
0009| A. A member may claim one year of service credit
|
0010| for each year in which a fire department certifies that the
|
0011| member:
|
0012| (1) attended seventy-five percent of all
|
0013| scheduled fire drills;
|
0014| (2) attended seventy-five percent of all
|
0015| scheduled business meetings; and
|
0016| (3) participated in at least fifty percent of
|
0017| all emergency response calls for which the fire department held
|
0018| him responsible to attend.
|
0019| B. The chief of each fire department shall submit
|
0020| to the [state fire marshal's office] association by [April
|
30] March 31 of each year the records of attendance of
|
0022| members for emergency response calls, fire drills and business
|
0023| meetings during the preceding calendar year; provided, he
|
0024| shall:
|
0025| (1) submit such records on forms provided by
|
0001| the [state fire marshal's office] association;
|
0002| (2) acknowledge the truth of the records under
|
0003| oath before a notary public; and
|
0004| (3) have the notarized forms signed by the
|
0005| mayor, if distributions from the fire protection fund for the
|
0006| fire department are made to an incorporated municipality, or
|
0007| the chairman of the county commission, if distributions from
|
0008| the fire protection fund for the fire department are made to an
|
0009| independent fire district."
