0011| RELATING TO EDUCATIONAL INSTITUTIONS; AMENDING THE UNIVERSITY

0012| RESEARCH PARK ACT TO INCLUDE COMMUNITY COLLEGES AND TECHNICAL
|
0013| AND VOCATIONAL INSTITUTES.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 21-28-3 NMSA 1978 (being Laws 1989,
|
0017| Chapter 264, Section 3) is amended to read:
|
0018| "21-28-3. DEFINITIONS.--As used in the University
|
0019| Research Park Act:
|
0020| A. "bond" or "bonds" means any bond, note or other
|
0021| evidence of indebtedness;
|
0022| B. "regents" means [the board of regents of a
|
0023| university]:
|
0024| (1) in the case of an educational institution
|
0025| named in Article 12, Section 11 of the constitution of New
|
0001| Mexico, the board of regents of the institution;
|
0002| (2) in the case of a community college, the
|
0003| community college board; and
|
0004| (3) in the case of a technical and vocational
|
0005| institute, the governing board of the technical and vocational
|
0006| institute district;
|
0007| C. "research park" means research and development
|
0008| facilities, research institutes, testing laboratories, offices,
|
0009| light manufacturing, related businesses and government
|
0010| installations and similar facilities, together with land,
|
0011| including all necessary appurtenances, rights and franchises
|
0012| acquired, constructed and developed by a university or under
|
0013| its authority which are suitable or necessary to promote the
|
0014| social welfare of the state of New Mexico through the
|
0015| advancement of education, science, research, economic
|
0016| development and related purposes;
|
0017| D. "research park corporation" means any
|
0018| corporation formed pursuant to the provisions of the University
|
0019| Research Park Act;
|
0020| E. "technological innovations" means research,
|
0021| development, prototype assembly, manufacture, patenting,
|
0022| licensing, marketing and sale of inventions, ideas, practices,
|
0023| applications, processes, machines, technology and related
|
0024| property rights of all kinds; and
|
0025| F. "university" means:
|
0001| (1) a New Mexico educational institution
|
0002| [established pursuant to the provisions of] named in
|
0003| Article 12, Section 11 of the constitution of New Mexico;
|
0004| (2) a community college organized pursuant to
|
0005| the Community College Act; and
|
0006| (3) a technical and vocational institute
|
0007| organized pursuant to the Technical and Vocational Institute
|
0008| Act."

|
0013| mark, and insert in lieu thereof "; and

0015| (4) an area vocational school organized pursuant

0016| to the Area Vocational School Act.",
|

0018| and thence referred to the APPROPRIATIONS AND FINANCE

0019| COMMITTEE.
