0011|     RELATING TO LOBBYING; PROHIBITING LOCAL OFFICIALS FROM BEING

0012|     EMPLOYED AS LOBBYISTS; AMENDING AND ENACTING SECTIONS OF THE
    |
0013|     NMSA 1978.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Lobbyist Regulation Act
    |
0017|     is enacted to read:
    |
0018|          "[<u>NEW MATERIAL</u>] LOCAL OFFICIALS PROHIBITED FROM LOBBYING
    |
0019|     EMPLOYMENT.--
    |
0020|               A.  No elected or appointed official of a county,
    |
0021|     district, city, town or village shall be employed as a
    |
0022|     lobbyist.
    |
0023|               B.  For the purposes of this section, "employed"
    |
0024|     means that a person is in a contractual relationship with
    |
0025|     another person in which the person employed receives
    |
0001|     compensation."
    |
0002|          Section 2.  Section 10-4-2 NMSA 1978 (being Laws 1909,
    |
0003|     Chapter 36, Section 2, as amended) is amended to read:
    |
0004|          "10-4-2.  <u>REMOVAL--CAUSES OF</u>.--<s>[Sec. 6.]</s> The following
    |
0005|     shall be causes for removal of any officer belonging to the
    |
0006|     class mentioned in <s>[the preceding]</s> Section <u>10-4-1 NMSA
</u>    |
<u></u>0007| <u>    1978</u>:
    |
0008|               <s>[1]</s> <u>A.</u>  conviction of any felony or of any
    |
0009|     misdemeanor involving moral turpitude;
    |
0010|               <s>[2]</s> <u>B.</u>  failure, neglect or refusal to discharge
    |
0011|     the duties of the office or failure, neglect or refusal to
    |
0012|     discharge any duty devolving upon the officer by virtue of his
    |
0013|     office;
    |
0014|               <s>[3]</s> <u>C.</u>  knowingly demanding or receiving illegal
    |
0015|     fees as such officer;
    |
0016|               <s>[4]</s> <u>D.</u>  failure to account for money coming into
    |
0017|     his hands as such officer;
    |
0018|               <s>[5]</s> <u>E.</u>  gross incompetency or gross negligence
    |
0019|     in discharging the duties of the office;
    |
0020|               <u>F.  lobbying in violation of the Lobbyist
</u>    |
<u></u>0021| <u>    Regulation Act; or</u>
    |
0022|               <s>[6]</s> <u>G.</u>  any other act <s>[or acts which]</s> <u>that</u>
    |
0023|     in the opinion of the court or jury <s>[amount]</s> <u>amounts</u> to
    |
0024|     corruption in office or gross immorality rendering the
    |
0025|     incumbent unfit to fill the office."
    |
0001|          Section 3.  EFFECTIVE DATE.--The effective date of the
    |
0002|     provisions of this act is July 1, 1997.
