0011| RELATING TO THE NEW MEXICO SCHOOL FOR THE VISUALLY HANDICAPPED;
|
0012| PROVIDING FOR QUALIFICATIONS OF REGENTS.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 21-5-2 NMSA 1978 (being Laws 1903,
|
0016| Chapter 2, Section 6, as amended) is amended to read:
|
0017| "21-5-2. MANAGEMENT OF [STATE INSTITUTIONS] NEW MEXICO
|
0018| SCHOOL FOR THE VISUALLY HANDICAPPED--CORPORATE POWERS.--
|
0019| A. The management and control of the New Mexico
|
0020| school for the visually handicapped, the care and preservation
|
0021| of all property of which it shall become possessed, the
|
0022| erection and construction of all buildings necessary for its
|
0023| use and the disbursement and expenditure of all [moneys]
|
0024| money appropriated by the state of New Mexico or [which]
|
0025| that shall otherwise come into [its] the school's
|
0001| possession shall be vested in a board of five [trustees. The
|
0002| incumbent trustees shall remain in office for the remainder of
|
0003| their present terms. Said Trustees shall possess the same
|
0004| qualifications, shall be appointed in the same manner, and
|
0005| their terms of office shall be the same and the vacancies
|
0006| therein shall be filled in the same manner, as is provided with
|
0007| reference to the regents of the university of New Mexico. Said
|
0008| trustees] regents, at least one of whom shall be visually
|
0009| handicapped, at least one other of whom shall be the parent of
|
0010| a visually handicapped child and at least two others of whom
|
0011| shall be the spouse, brother, sister, daughter or son of a
|
0012| visually handicapped person. No more than one regent shall
|
0013| reside in Otero county.
|
0014| B. The regents and their successors in office
|
0015| shall constitute a body corporate under the name and style of
|
0016| "the [trustees] board of regents of the New Mexico school
|
0017| for the visually handicapped". [with] The board has the
|
0018| right as such of suing and being sued, of contracting and being
|
0019| contracted with, of making and using a common seal and altering
|
0020| the same at pleasure and of causing all things to be done
|
0021| necessary to carry out the provisions of [this] Chapter 21,
|
0022| Article 5 NMSA 1978. A majority of the board shall
|
0023| constitute a quorum for the transaction of business, but a
|
0024| [less] smaller number may adjourn from time to time. The
|
0025| officers of the board shall be elected in the same manner and
|
0001| possess the same qualifications as the officers of the board
|
0002| of regents of the university of New Mexico [now possess. The
|
0003| board shall require corporate surety bonds, in a reasonable
|
0004| amount set by the board, of all officers and employees who have
|
0005| custody of or handle funds of the institutions conditioned on
|
0006| the faithful performance of their duties. The governor shall
|
0007| be ex officio a member of the board but shall not have the
|
0008| right to vote or be eligible to office]."
