0011| RELATING TO MUNICIPALITIES; REQUIRING CERTAIN MUNICIPALITIES TO

0012| CONDUCT AN ELECTION PRIOR TO CHANGING THE ZONING OR USE OF
|
0013| CERTAIN AREAS.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Municipal Code is enacted
|
0017| to read:
|
0018| "[NEW MATERIAL] CERTAIN MUNICIPALITIES--CHANGING THE
|
0019| ZONING OR USE OF CERTAIN AREAS--ELECTION REQUIRED.--No
|
0020| municipality that has a population of one thousand five hundred
|
0021| or less at the last federal decennial census and that is
|
0022| partially bordered, at the time of that census, by federal land
|
0023| managed by the United States forest service, shall change the
|
0024| zoning or use of any land acquired without first submitting the
|
0025| question to the voters at a general election or at a special
|
0001| election called for that purpose if the acquired land:
|
0002| A. was acquired by the municipality from or with
|
0003| the permission of the United States forest service;
|
0004| B. lies adjacent to the municipality's geographical
|
0005| boundary; and
|
0006| C. is zoned or used at the time of acquisition for
|
0007| recreation, school sites, greenbelt or buffer land."
