0012| ACTS; ESTABLISHING CRIMINAL PENALTIES; PROVIDING FOR PRIVATE

0013| REMEDIES; REPEALING CERTAIN SECTIONS OF THE NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. SHORT TITLE.--This act may be cited as the
|
0017| "Telecommunications Service Theft Act".
|
0018| Section 2. DEFINITIONS.--As used in the
|
0019| Telecommunications Service Theft Act:
|
0020| A. "provider" means a person that offers
|
0021| telecommunications service for lawful compensation; and
|
0022| B. "telecommunications service" means any audio,
|
0023| video, data or programming offered for a fee or other
|
0024| consideration to facilitate the origination, transmission,
|
0025| emission or reception of signs, signals, data, writings,
|
0001| images, sounds or intelligence of any nature delivered by
|
0002| telephone or telephone service, cable television service,
|
0003| including cellular or other wireless telephones, wire, radio,
|
0004| electromagnetic, photoelectronic or photo-optical equipment,
|
0005| coaxial or fiber optic cable, terrestrial microwave, television
|
0006| broadcast or satellite transmission.
|
0007| Section 3. ILLEGAL SERVICE--PROHIBITED ACTS--PENALTIES.--
|
0008| A. It is unlawful for any person to:
|
0009| (1) obtain or attempt to obtain
|
0010| telecommunications service by trick, artifice, deception, use
|
0011| of an illegal device or decoder or other fraudulent means
|
0012| without authorization of the provider;
|
0013| (2) assist or instruct any person to obtain or
|
0014| attempt to obtain any telecommunications service without
|
0015| authorization of the provider;
|
0016| (3) make or attempt to make or assist any
|
0017| person to make or maintain a telecommunications service
|
0018| connection, whether physical, electrical, mechanical,
|
0019| acoustical or by other means, with any cables, wires,
|
0020| components or other devices used for the distribution of
|
0021| telecommunications service without authorization of the
|
0022| provider; or
|
0023| (4) make or maintain any modification or
|
0024| alteration to any device that was installed with the
|
0025| authorization of the provider for the purpose of intercepting
|
0001| or receiving any telecommunications service without
|
0002| authorization of the provider.
|
0003| B. Any person who violates this section is guilty
|
0004| of a misdemeanor upon conviction for a first offense and shall
|
0005| be punished as provided in Section 31-19-1 NMSA 1978; and upon
|
0006| conviction for a second or subsequent offense, is guilty of a
|
0007| fourth degree felony and shall be punished as provided in
|
0008| Section 31-18-15 NMSA 1978.
|
0009| Section 4. ILLEGAL DEVICES--PROHIBITED ACTS--PENALTIES.--
|
0010| A. It is unlawful for any person to:
|
0011| (1) own or possess any device, including a
|
0012| printed circuit board, designed to receive or permit reception
|
0013| of any telecommunications service, regardless of whether that
|
0014| service is encoded, filtered, scrambled or otherwise made
|
0015| unintelligible, with the intent to distribute such device for
|
0016| the purpose of permitting reception or use of
|
0017| telecommunications service without authorization by the
|
0018| provider;
|
0019| (2) publish or advertise for sale or lease any
|
0020| kit or plan for a device designed in whole or in part to
|
0021| receive without authorization of the provider any
|
0022| telecommunications service, regardless of whether that service
|
0023| is encoded, filtered, scrambled or otherwise made
|
0024| unintelligible;
|
0025| (3) advertise for sale or lease any device or
|
0001| printed circuit or kit for a device or printed circuit designed
|
0002| in whole or in part to receive any telecommunications service
|
0003| without authorization of the provider, regardless of whether
|
0004| the service is encoded, filtered, scrambled or otherwise made
|
0005| unintelligible; or
|
0006| (4) manufacture, import into New Mexico,
|
0007| distribute, sell, lease or offer for sale or lease any device,
|
0008| printed circuit or any plan or kit for a device or for a
|
0009| printed circuit, designed in whole or in part to receive any
|
0010| telecommunications service, regardless of whether the service
|
0011| is encoded, filtered, scrambled or otherwise made
|
0012| unintelligible, that can be used to receive that service
|
0013| without the authorization of the provider.
|
0014| B. Any person who violates this section is guilty
|
0015| of a fourth degree felony upon conviction for a first offense
|
0016| and shall be punished as provided in Section 31-18-15 NMSA
|
0017| 1978; and upon conviction for a second or subsequent offense,
|
0018| is guilty of a third degree felony and shall be punished as
|
0019| provided in Section 31-18-15 NMSA 1978.
|
0020| Section 5. PRIVATE REMEDIES.--
|
0021| A. A person damaged by a violation of Section 3 or
|
0022| 4 of the Telecommunications Service Theft Act may be granted an
|
0023| injunction under the principles of equity and on terms that the
|
0024| court considers reasonable. Proof of monetary damage, loss of
|
0025| revenue or intent to deceive and take unfair advantage of any
|
0001| person is not required.
|
0002| B. The relief provided in this section is in
|
0003| addition to remedies otherwise available against the same
|
0004| conduct under the common law or other New Mexico statutes.
|
0005| Section 6. REPEAL.--Sections 63-10-1 through 63-10-3 NMSA
|
0006| 1978 (being Laws 1977, Chapter 95, Section 1 and Laws 1985,
|
0007| Chapter 74, Sections 3 and 1, as amended) are repealed.
|
0008| Section 7. SEVERABILITY.--If any part of the
|
0009| Telecommunications Service Theft Act is held invalid, the
|
0010| remainder or its application to other situations or persons
|
0011| shall not be affected.

0014| 31-18-15 NMSA 1978." and insert in lieu thereof "by either a
|
0015| fine of not less than five hundred dollars ($500) or more than
|
0016| one thousand dollars ($1,000), by imprisonment for a definite
|
0017| term not to exceed thirty days, or both.".

0019| 4. On page 4, line 12, strike "fourth degree felony" and
|
0020| insert in lieu therof "misdemeanor".

0022| 5. On page 4, line 13, strike "as provided in Section 31-

0023| 18-15 NMSA 1978;" and insert in lieu therof "by either a fine of
|
0024| not less than one thousand dollars ($1,000), imprisonment for a
|
0025| definite term of not less than thirty days, or both;".
