SALAZAR | 0006| | 0007| FOR THE | 0008| SCIENCE, TECHNOLOGY, ENERGY AND DEFENSE CONVERSION COMMITTEE | 0009| | 0010| AN ACT | 0011| RELATING TO EDUCATION; AMENDING SECTION 21-19-7 NMSA 1978 | 0012| (BEING LAWS 1983, CHAPTER 299, SECTION 1, AS AMENDED) TO ALLOW | 0013| THE USE OF IN-PLANT TRAINING FUNDS FOR AGRIBUSINESS. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 21-19-7 NMSA 1978 (being Laws 1983, | 0017| Chapter 299, Section 1, as amended) is amended to read: | 0018| "21-19-7. DEVELOPMENT TRAINING.-- | 0019| A. The economic development department shall | 0020| establish a development training program that provides quick- | 0021| response classroom and in-plant training to furnish qualified | 0022| manpower resources for new or expanding industries, | 0023| agribusinesses and nonretail service sector businesses in New | 0024| Mexico that have business or production procedures that require | 0025| skills unique to those industries. For purposes of this | 0001| subsection, "agribusiness" means a business whose primary | 0002| purpose is the production, processing or distribution of | 0003| agricultural products. Training shall be custom-designed for | 0004| the particular company and shall be based on the special | 0005| requirements of each company. The program shall be operated on | 0006| a statewide basis and shall be designed to assist any area in | 0007| becoming more competitive economically. | 0008| B. There is created the "industrial training | 0009| board", which shall be composed of: | 0010| (1) the director of the economic development | 0011| division of the economic development department; | 0012| (2) the director of the vocational education | 0013| division of the state department of public education; | 0014| (3) the director of the job training division | 0015| of the labor department; | 0016| (4) the executive director of the commission | 0017| on higher education; | 0018| (5) one member from organized labor appointed | 0019| by the governor; and | 0020| (6) one public member from the business | 0021| community appointed by the governor. | 0022| C. The industrial training board shall establish | 0023| policies and promulgate rules and regulations for the | 0024| administration of appropriated funds and shall provide review | 0025| and oversight to assure that funds expended from the | 0001| development training fund will generate business activity and | 0002| give measurable growth to the economic base of New Mexico | 0003| within the legal limits preserving the ecological state of New | 0004| Mexico and its people. | 0005| D. Subject to the approval of the industrial | 0006| training board, the vocational education division of the state | 0007| department of public education shall: | 0008| (1) administer all funds allocated or | 0009| appropriated for industrial development training purposes; | 0010| (2) provide designated training services; | 0011| (3) regulate, control and abandon any training | 0012| program established under the provisions of this section; | 0013| (4) assist companies requesting training in | 0014| the development of a training proposal to meet the companies' | 0015| manpower needs; | 0016| (5) contract for the implementation of all | 0017| training programs; | 0018| (6) provide for training by educational | 0019| institutions or by the company through in-plant training, at | 0020| the company's request; and | 0021| (7) evaluate training efforts on a basis of | 0022| performance standards set forth by the industrial training | 0023| board. | 0024| E. The state shall contract with a company or an | 0025| educational institution to provide training or instructional | 0001| services in accordance with the approved training proposal and | 0002| within the following limitations: | 0003| (1) no payment shall be made for training in | 0004| excess of one thousand forty hours of training per trainee for | 0005| the total duration of training; | 0006| (2) training applicants shall have resided | 0007| within the state for a minimum of one year immediately prior to | 0008| the commencement of the training program and be citizens of the | 0009| United States; | 0010| (3) payment for institutional classroom | 0011| training shall be made under any accepted training contract for | 0012| a qualified training program; | 0013| (4) no payment shall be made under any | 0014| accepted training contract for rental of facilities unless | 0015| facilities are not available on site or at the educational | 0016| institution; | 0017| (5) all applicants shall be eligible under the | 0018| federal Fair Labor Standards Act and shall not have terminated | 0019| a public school program within the past three months except by | 0020| graduation; | 0021| (6) trainees shall be guaranteed full-time | 0022| employment with the contracted company upon successful | 0023| completion of the training; | 0024| (7) persons employed to provide the | 0025| instructional services shall be exempt from the minimum | 0001| requirements established in the state plan for other state | 0002| vocational programs; and | 0003| (8) no payment shall be made for training | 0004| programs or production of Indian jewelry or imitation Indian | 0005| jewelry unless a majority of those involved in the training | 0006| program or production are of Indian descent." | 0007|  State of New Mexico | 0008| House of Representatives | 0009| | 0010| FORTY-THIRD LEGISLATURE | 0011| FIRST SESSION, 1997 | 0012| | 0013| | 0014| February 6, 1997 | 0015| | 0016| | 0017| Mr. Speaker: | 0018| | 0019| Your AGRICULTURE AND WATER RESOURCES COMMITTEE, | 0020| to whom has been referred | 0021| | 0022| HOUSE BILL 207 | 0023| | 0024| has had it under consideration and reports same with | 0025| recommendation that it DO PASS, and thence referred to the | 0001| APPROPRIATIONS AND FINANCE COMMITTEE. | 0002| | 0003| Respectfully submitted, | 0004| | 0005| | 0006| | 0007| | 0008| | 0009| G.
