PARSONS | 0005| | 0006| | 0007| | 0008| FOR THE INTEGRATED WATER AND RESOURCE PLANNING COMMITTEE | 0009| | 0010| AN ACT | 0011| RELATING TO WATER; AMENDING A SECTION OF THE NMSA TO EXTEND | 0012| AUTHORITY OF THE STATE ENGINEER TO REGULATE CERTAIN DAMS. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. Section 72-5-32 NMSA 1978 (being Laws 1941, | 0016| Chapter 126, Section 25, as amended) is amended to read: | 0017| "72-5-32. CONSTRUCTION OF DAMS EXCEEDING TEN FEET IN | 0018| HEIGHT.--Any person, association or corporation, public or | 0019| private, the state [of New Mexico] or the United States [of | 0020| America] hereafter intending to construct a dam [to impound | 0021| the public waters of the state for any purpose which dam] | 0022| that exceeds ten feet in height above the lowest natural | 0023| ground surface elevation or impounds more than ten acre-feet of | 0024| water shall [comply with the provisions of Laws 1941, Chapter | 0025| 126, as amended, applicable to the appropriation and | 0001| utilization of water] submit detailed plans to the state | 0002| engineer for approval before construction. If the state | 0003| engineer finds that the dam is safe, he shall approve the | 0004| plans; provided that this section shall not [be construed | 0005| to] apply to stock dams whose maximum storage capacity does | 0006| not exceed ten acre-feet [Publication of notice pursuant to | 0007| Section 72-5-4 NMSA 1978 shall not be required for applications | 0008| to construct dams which do not impound or divert water for | 0009| beneficial use.
