0001| AN ACT | 0002| RELATING TO PUBLIC FINANCES; REQUIRING STATE AGENCIES TO FURNISH | 0003| QUARTERLY REPORTS TO THE LEGISLATURE REGARDING THE STATUS OF | 0004| CERTAIN FUNDS WITHIN THE CONTROL OF EACH AGENCY. | 0005| | 0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0007| Section 1. PERMANENT, TRUST AND ESCROW FUNDS--ANNUAL REPORT | 0008| REQUIRED--CONTENT.-- | 0009| A. Semiannually, each state agency shall furnish to each member of the | 0010| legislature so requesting a report summarizing the status of each permanent, trust or escrow fund | 0011| under that agency's control. The report shall include all permanent, trust or escrow funds | 0012| established by law or agreement. | 0013| B. Each report furnished pursuant to Subsection A of this section shall include: | 0014| (1) a description of each fund reported, the legal or contractual basis for | 0015| the creation of the fund and the permitted uses of the fund; and | 0016| (2) the total amount of money in the fund, including the balance of the | 0017| fund at the beginning and ending of the previous fiscal year, the balance of the fund at the end of | 0018| the most recent quarter of the fiscal year and the amount of any interest or capital appreciation | 0019| that accrued to the fund during the most recent quarter of the fiscal year. | 0020| C. For purposes of this section, "state agency" means any department, | 0021| board, commission, hospital district, constitutionally or statutorily created public, post- | 0022| secondary educational institution, the mortgage finance authority or the New Mexico | 0023| finance authority. |
