0012| PROPOSING AN AMENDMENT TO ARTICLE 20 OF THE CONSTITUTION OF NEW

0013| MEXICO TO ADD A NEW SECTION MAKING SPANISH THE OFFICIAL LANGUAGE

0016| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. It is proposed to amend Article 20 of the
|
0018| constitution of New Mexico by adding a new section to read:
|
0019| "A. Spanish is the historic language of the people
|
0020| of the state of New Mexico. This section is intended to
|
0021| preserve, protect and strengthen the Spanish language and not to
|
0022| supersede any of the rights guaranteed to the people by this
|
0023| constitution.
|
0024| B. Spanish is the official language of the state of
|
0025| New Mexico.
|
0001| C. The legislature shall enforce this section by
|
0002| appropriate legislation. The legislature and officials of the
|
0003| state of New Mexico shall take all steps necessary to ensure
|
0004| that the role of Spanish as the common language of the state of
|
0005| New Mexico is preserved and enhanced. The legislature shall
|
0006| make no law that diminishes or ignores the role of Spanish as
|
0007| the common language of the state of New Mexico.
|
0008| D. Any person who is a resident or who is doing
|
0009| business in the state of New Mexico shall have standing to sue
|
0010| the state of New Mexico to enforce this section, and the
|
0011| district courts shall have jurisdiction to hear cases brought to
|
0012| enforce this section. The legislature may provide for
|
0013| reasonable and appropriate limitations on the time and manner of
|
0014| suits brought under this section."
|
0015| Section 2. The amendment proposed by this resolution shall
|
0016| be submitted to the people for their approval or rejection at
|
0017| the next general election or at any special election prior to
|
0018| that date which may be called for that purpose.
