0012|     PROPOSING AN AMENDMENT TO ARTICLE 7 OF THE CONSTITUTION OF NEW

0013|     MEXICO TO ALLOW MUNICIPALITIES TO CONDUCT RUNOFF ELECTIONS.

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|       Section 1.  It is proposed to amend Article 7, Section 5 of
    |
0017|     the constitution of New Mexico to read:
    |
0018|            "<u>A.</u>  All elections shall be by ballot. <s>[and]</s> The
    |
0019|     person who receives the highest number of votes for any office,
    |
0020|     <u>except as provided in Subsection B of this section, and</u> except
    |
0021|     in the cases of the offices of governor and lieutenant governor,
    |
0022|     shall be declared elected <s>[thereto]</s> <u>to that office</u>.  The
    |
0023|     joint candidates receiving the highest number of votes for the
    |
0024|     offices of governor and lieutenant governor shall be declared
    |
0025|     elected to those offices.
    |
0001|            <u>B.  A municipality may, by resolution, provide for
</u>    |
<u></u>0002| <u>    runoff elections</u>."
    |
0003|       Section 2.  The amendment proposed by this resolution shall
    |
0004|     be submitted to the people for their approval or rejection at
    |
0005|     the next general election or at any special election prior to
    |
0006|     that date which may be called for that purpose.
