0012| REQUESTING THE CONSTRUCTION INDUSTRIES DIVISION OF THE
|
0013| REGULATION AND LICENSING DEPARTMENT TO CREATE A SPECIALTY
|
0014| LICENSE FOR RESIDENTIAL LEAD-BASED PAINT ABATEMENT.
|

0016| WHEREAS, lead poisoning is the number one preventable
|
0017| environmental health threat to children and causes irreversible
|
0018| damage; and
|
0019| WHEREAS, there are currently no regulations governing
|
0020| residential lead-based paint abatement, cleanup or removal in
|
0021| New Mexico and improper abatement can create a serious health
|
0022| hazard for children and adults; and
|
0023| WHEREAS, the United States environmental protection agency
|
0024| is issuing regulations to implement the Residential Lead-Based
|
0025| Paint Hazard Reduction Act of 1992 (Title X), which requires
|
0001| disclosure of lead-based paint hazards prior to sale and rental
|
0002| of housing constructed before 1978 and establishes specific
|
0003| training and certification requirements for contractors who
|
0004| engage in lead testing and abatement;
|
0005| WHEREAS, buyers and sellers of real estate in New Mexico
|
0006| will need access to contractors trained and licensed for lead-based paint abatement when the Lead-Based Paint Disclosure Rule
|
0007| of Title X is implemented in order to be in compliance with
|
0008| federal law and avoid undue liability and financial risk; and
|
0009| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0010| STATE OF NEW MEXICO that the construction industries division of
|
0011| the regulation and licensing department, in cooperation with the
|
0012| department of health, be requested to use its existing license
|
0013| classifications and procedures to issue a specialty license for
|
0014| residential lead-based paint abatement prior to the Lead-Based
|
0015| Paint Disclosure Rule of Title X taking effect; and
|
0016| BE IT FURTHER RESOLVED that the department of health be
|
0017| requested to review and analyze programs and legislation
|
0018| established by other states in order to develop a comprehensive
|
0019| plan for protecting New Mexico citizens from lead-based paint
|
0020| hazards and conduct a cost/benefit analysis of the plan; and
|
0021| BE IT FURTHER RESOLVED that the department of health be
|
0022| requested to develop educational materials to inform the public
|
0023| and professional organizations about lead poisoning prevention,
|
0024| real estate disclosure, lead testing and abatement; and
|
0025| BE IT FURTHER RESOLVED that the department of health and
|
0001| the regulation and licensing department submit full reports to
|
0002| the legislative health and human services committee by November
|
0003| 15, 1996; and
|
0004| BE IT FURTHER RESOLVED that copies of this memorial be
|
0005| transmitted to the secretary of health and the superintendent of
|
0006| regulation and licensing.
