0012|     RELATING TO COURTS; REMOVING SUPERVISORY CONTROL OF THE

0013|     MAGISTRATE COURT FROM THE ADMINISTRATIVE OFFICE OF THE COURTS;

0014|     AMENDING AND REPEALING SECTIONS OF THE NMSA 1978.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  Section 35-7-1 NMSA 1978 (being Laws 1968,
    |
0018|     Chapter 62, Section 96) is amended to read:
    |
0019|       "35-7-1.  MAGISTRATE ADMINISTRATION--SUPERVISION.--The
    |
0020|     [administrative office of the courts] supreme court has
    |
0021|     supervision and control of the administration of the magistrate
    |
0022|     court.  The [director of the administrative office of the
    |
0023|     courts shall promulgate and enforce regulations] supreme court
    |
0024|     shall adopt rules governing the administration of the
    |
0025|     magistrate court. [and any magistrate who violates any
    |
0001|     regulation promulgated by the director is guilty of a petty
    |
0002|     misdemeanor and, upon conviction, shall be removed from office. 
    |
0003|     The administrative office] The supreme court shall enforce
    |
0004|     all laws relating to administration of the magistrate court
    |
0005|     [and the attorney general shall investigate and assist whenever
    |
0006|     requested to do so by the administrative office]."
    |
0007|       Section 2.  REPEAL.--Section 35-7-2 NMSA 1978 (being Laws
    |
0008|     1968, Chapter 62, Section 97) is repealed.
    |
0009|       Section 3.  EFFECTIVE DATE.--The effective date of the
    |
0010|     provisions of this act is July 1, 1996.
