0001| | 0002| SENATE BILL 645 | 0003| 42ND LEGISLATURE - STATE OF NEW MEXICO - SECOND SESSION, | 0004| 1996 | 0005| INTRODUCED BY | 0006| NANCY RODRIGUEZ | 0007| | 0008| | 0009| | 0010| | 0011| | 0012| AN ACT | 0013| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0014| SEVERANCE TAX BONDS FOR CAPITAL OUTLAY PROJECTS IN THE CITY OF | 0015| SANTA FE LOCATED IN SANTA FE COUNTY; MAKING APPROPRIATIONS; | 0016| DECLARING AN EMERGENCY. | 0017| | 0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0019| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0020| APPROPRIATION OF PROCEEDS.-- | 0021| A. The state board of finance may issue and sell | 0022| severance tax bonds in compliance with the Severance Tax Bonding | 0023| Act in an amount not to exceed the total of the amounts | 0024| authorized for purposes specified in Sections 2 through 6 of | 0025| this act. The state board of finance shall schedule the | 0001| issuance and sale of the bonds in the most expeditious and | 0002| economical manner possible upon a finding by the board that the | 0003| project has been developed sufficiently to justify the issuance | 0004| and that the project can proceed to contract within a reasonable | 0005| time. The state board of finance shall further take the | 0006| appropriate steps necessary to comply with the Internal Revenue | 0007| Code of 1986, as amended. Proceeds from the sale of the bonds | 0008| are appropriated for the purposes specified in Sections 2 | 0009| through 6 of this act. | 0010| B. The agencies named in Sections 2 through 6 of | 0011| this act shall certify to the state board of finance when the | 0012| money from the proceeds of the severance tax bonds authorized in | 0013| this section is needed for the purposes specified in the | 0014| applicable section of this act. | 0015| C. If the specified agency has not certified the | 0016| need for the issuance of the bonds by the end of fiscal year | 0017| 1998, the authorization provided in this act shall be void. | 0018| D. Unless otherwise specified in this act, any | 0019| unexpended or unencumbered balance remaining from the proceeds | 0020| of severance tax bonds issued pursuant to Sections 2 through 6 | 0021| of this act at the end of fiscal year 1999 shall revert to the | 0022| severance tax bonding fund. | 0023| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0024| ADMINISTRATION--PURPOSE.--Pursuant to the provisions of Section | 0025| 1 of this act, upon certification by the local government | 0001| division of the department of finance and administration that | 0002| the need exists for the issuance of the bonds, one hundred fifty | 0003| thousand dollars ($150,000) is appropriated to the local | 0004| government division of the department of finance and | 0005| administration for the purpose of designing, constructing and | 0006| equipping the Agua Fria park located in Santa Fe county. | 0007| Section 3. SEVERANCE TAX BONDS--STATE HIGHWAY AND | 0008| TRANSPORTATION DEPARTMENT--PURPOSE.--Pursuant to the provisions | 0009| of Section 1 of this act, upon certification by the state | 0010| highway and transportation department that the need exists for | 0011| the issuance of the bonds, four hundred twenty thousand dollars | 0012| ($420,000) is appropriated to the state highway and | 0013| transportation department for the purpose of repaving and making | 0014| improvements to a portion of Agua Fria road in the city of Santa | 0015| Fe located in Santa Fe county. | 0016| Section 4. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--PURPOSE.--Pursuant to the provisions of Section 1 of this act, | 0017| upon certification by the state agency on aging that the need | 0018| exists for the issuance of the bonds, five hundred thousand | 0019| dollars ($500,000) is appropriated to the state agency on aging | 0020| for the purpose of designing, constructing and equipping a south | 0021| side senior citizen center in the city of Santa Fe located in | 0022| Santa Fe county. | 0023| Section 5. SEVERANCE TAX BONDS--DEPARTMENT OF | 0024| ENVIRONMENT--PURPOSE.--Pursuant to the provisions of Section 1 | 0025| of this act, upon certification by the department of environment | 0001| that the need exists for the issuance of the bonds, two hundred | 0002| thousand dollars ($200,000) is appropriated to the department of | 0003| environment for the purpose of conducting a feasibility study to | 0004| design and construct a sewer system that ties the area of Alamo | 0005| lane, Camino de los Lopez and Agua Fria street to the Santa Fe | 0006| river sewer trunk line located in Santa Fe county. | 0007| Section 6. SEVERANCE TAX BONDS--STATE DEPARTMENT OF PUBLIC | 0008| EDUCATION--PURPOSES.--Pursuant to the provisions of Section 1 of | 0009| this act, upon certification by the state department of public | 0010| education that the need exists for the issuance of the bonds, | 0011| the following amounts are appropriated to the state department | 0012| of public education for the following purposes: | 0013| A. two hundred fifty thousand dollars ($250,000) to | 0014| be distributed equally among Agua Fria, Alvord, Gonzales, | 0015| Larragoite and Sweeney elementary schools located in Santa Fe | 0016| county to purchase playground equipment; | 0017| B. one hundred thousand dollars ($100,000) to be | 0018| distributed equally between Alameda junior high school and | 0019| Edward A. Ortiz middle school located in Santa Fe county to | 0020| purchase computers and library books; and | 0021| C. fifty thousand dollars ($50,000) to purchase | 0022| computers and library books for Capital high school located in | 0023| Santa Fe county. | 0024| Section 7.
