0012|     RELATING TO PUBLIC ASSISTANCE; LIMITING THE TERMINATION OF

0013|     PUBLIC ASSISTANCE TO DEPENDENT CHILDREN; ENACTING A NEW SECTION

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|       Section 1.  A new section of the Public Assistance Act is
    |
0018|     enacted to read:
    |
0019|       "[<u>NEW MATERIAL</u>]  PUBLIC ASSISTANCE TO DEPENDENT CHILDREN--LIMITATION ON TERMINATION.--Public assistance to eligible
    |
0020|     persons granted pursuant to Section 27-2-6 NMSA 1978 may not be
    |
0021|     reduced unless and until:
    |
0022|            A.  support rights obligations for such persons have
    |
0023|     been enforced and recovered by the department;
    |
0024|            B.  the department has been repaid for public
    |
0025|     assistance furnished under Section 27-2-6 NMSA 1978; and
    |
0001|            C.  the support rights payments are being made
    |
0002|     directly to the person receiving public assistance."
